No, we had a ban on imports and sales of new firearms Not a single existing firearm was banned.

No, it didn’t.

But this, this is the real reason I’m updating this column. I was happily listening to an Irish History podcast after I finished this article and had it up. Computer shut down for the night, supper finally awaiting me. This podcast was on the life of Dennis Doherty, a man who originally enlisted in the British army (he shoulda known better) to escape starvation in Ireland as many young lads did. He spent the next 45 years or so trying to escape prison. If you want to listen to the about 30 minute podcast I’m going to give the link. This podcast was done on May 12, 2013. Yes, it matters. Long before the rise of the cult Covidian. One of the prisons he wound up in was in Port Arthur in Tasmania. It’s what was known as a “model prison” with the goal of reforming the prisoners by breaking them down. Dennis had a penchant for trying to escape prison you see, what with a desire for freedom and all. But the treatment the prisoners received in the “model prison” was what dropped my jaw. This would have been somewhere between 1858-1863. No that’s not a typo, I mean well over a hundred years ago. The prisoners were kept in strict isolation. If they were allowed out of their cells they were to maintain 4.5 meters of space from everyone and they had to have their faces covered with a cloth mask at all times. Prisoners were only referred to by their prison number, not their name. The result? Many of the prisoners went insane. Isn’t that fascinating. This isn’t knew knowledge, they knew the results of these policies. This podcast is 10 years old. Not new knowledge. I hope ya’ll don’t mind this add in.

And what were some of the consequences of the seizure of citizen’s rights during the plandemic? Well, obvious one is freedom of speech. Doctors that tried to speak out and let people know there was cheap, readily available treatment that could have saved lives were muzzled and silenced.

Hating back

Sometimes I hear something that makes me cock my head, with a huh expression. Probably like how Shimshon looks when I ask him why my package is chewed open at the gate. I’ll explain.

I’m sure many heard growing up “We love the person, but hate the behavior”. Or “Hate isn’t the opposite of love, apathy is”. I had a discussion with a girlfriend about that a couple of days ago. My opinion has changed. I can see in some situations now where apathy has been a lazy response on my part to a situation where a different emotion would have been more correct and in line. So what brought all this up? A podcast. Lenny Goldberg has a radio show, Jewish Truth Bombs, that I try to catch, he has a lot to say that makes sense to me. This one was no exception. The relevant part is only about 19 minutes or so, the last couple are commercials.

In case you don’t want to listen, I’ll give you the parts I’m pulling from it, but it’s all good. The topic was Purim, and some elements are in it that are often glossed over. Something Comrade X alluded to in the comments on my last column. Lenny points out that in Kohelet (Ecclesiastes) Chapter 3

1 Everything has an appointed season, and there is a time for every matter under the heaven.

2 A time to give birth and a time to die; a time to plant and a time to uproot that which is planted.

3 A time to kill and a time to heal; a time to break and a time to build.

4 A time to weep and a time to laugh; a time of wailing and a time of dancing.

It says there is a time for hate. As much as a time for love, there is a time when hate is the appropriate response. He also points out that we are commanded to kill Amelek

The Torah lists two mitzvahs regarding Amalek:

To obliterate the nation of Amalek (timcheh et zecher Amalek).

To never forget the evil deeds Amalek did (zechor al tishkach)

Had they been wiped out, Haman wouldn’t have been around.

Several centuries later, after Shaul was crowned king, the prophet Shmuel ordered him to fulfill G‑d’s commandment thus:3 “Smite Amalek, and utterly destroy all that is his. And have no pity on him; slay both man and woman, infant and suckling, ox and sheep, camel and donkey.”

Shaul gathered the Jewish people together and waged war against the Amalekites, slaying the entire nation and destroy­ing their property. Lenny points out Judaism is about knowing when to have mercy, and when to flip the attribute of mercy. That at times, the correct answer is to hate, or be cruel. If you are merciful to the cruel, eventually you will be cruel to the merciful. He says accepting the yoke of heaven is knowing the time for each attribute, and being willing to carry out that task, and that no, sometimes it’s not easy. That if you can’t hate Haman, the way you love Mordachai, if you can’t hate at the proper time, then you are just a nice guy. You’re a nice person, but that has nothing to do with accepting the yoke of the mitzvot. Lenny points out that Shaul didn’t kill Agag, and when Agag saw Shmuel approach he thought the death sentence had been lifted, seeing as how Shmuel looked all sweet and innocent. Shmuel proceeded to cut him into pieces with his sword. Sometimes the appropriate answer is hate. When the first day of self-defense was completed, The King asked Queen Esther “What else would you like?” Does Ester say, oh let’s all get along. Lets go out for supper. Nope, she says let us have another day of vengeance to wipe out the people the wanted to kill them all. And she wanted the 10 sons of Haman’s hung. Publicly. I love Queen Esther.

In the podcast Lenny refers to the attacks in Huwara, in case you haven’t heard, here are some salient points, there’s more info in the article.

Some facts you need to know about the murder of Israeli Jews, Palestinian Arab terrorism and Huwara, because they seem to have escaped the attention of your Western media and the Biden Administration who just met their Palestinian Arab counterparts in Aqaba, Jordan, and arranged to give them more guns while they castigate Israel for responding to increasingly deadly Palestinian Arab violence morally supported by the current Democrat Administration.

1. Palestinian Arab terrorists in the northern Samaria terror hub of Huwara murdered two brothers, Hillel and Yagel Yaniv. The Yaniv brothers were executed in a rain of bullets after the terrorists had rammed their vehicle into them before gunning them down as they sat trapped in their car.

2. The attack was predictable. In the month leading up to their murder, Palestinian Arabs carried out an average of two-three rock and Molotov cocktail attacks a day against Israeli cars in Huwara and on the Gilad route leading through the village.

3. Following the murder of the Jewish brothers, Huwara residents celebrated by handing out sweets. They also held an official firework celebration,

4. Among the main celebrants was the owner of a car and spare parts lot named Ayed Maharab. Maharab is a paroled terrorist who spent five years in Israeli prison. His Facebook page is filled with celebrations of terrorist attacks and of himself holding an AK-47. Maharab published a post following the Yaniv brothers’ murders celebrating the attack.

5. Following the murder of their friends and neighbors, and after seeing the Arab celebration of their murder, a number of young Israelis from surrounding villages entered Huwara and committed acts of vigilante violence. Among other things, they burned Maharab’s car lot. The scenes you saw of burning vehicles was Maharab’s spare parts lot. No building and no individual Arab was attacked or hurt by the aggrieved and angry friends of Hillel and Yagel. The claims of a death were lies.

The appropriate response came from Bezalel Smotrich:

The United Nations today (Thursday) condemned the statement of Israeli Finance Minister Bezalel Smotrich that he would like to see the Arab village of Huwara, where two Jewish brothers were murdered on Sunday, “wiped out.”

Stephane Dujarric, spokesman for UN Secretary General Antonio Guterres, called Smotrich’s comments “irresponsible” and “unacceptable.”

This was far from the first attack in Huwara.

An inappropriate response came from a moonbat leftist named appropriately enough, Yaya Fink.

Esti Yaniv, whose sons Hillel and Yagel were murdered by a terrorist in the Arab village of Huwara on Sunday, has expressed her horror at the launch of a campaign of support for the residents of Huwara, the initiative of left-winger and Labor Party activist Yaya Fink.

Fink is collecting donations for what he defines as the “Huwara pogrom victims.” The “pogrom” referred to occurred several hours after the murders of the Yaniv brothers, when dozens of Jews converged on Huwara and set fire to cars in scrapyards, also causing fire damage to several buildings. According to uncorroborated Palestinian-Arab accounts, one person lost his life in circumstances that are unclear.

“Every day, I look down at the murderous village of Huwara where the murderer of my sons is still walking free, where they handed out pastries and celebrated after the murder,” Esti Yaniv said. “I was horrified to hear of this dreadful campaign, [launched] a day after many of the residents of Huwara celebrated after the murder of my sons.”

And just a few days later, Terror attack in Tel Aviv: Three people shot, terrorist eliminated Lather, rinse, repeat.

And for those on the left that like to engage in moral relativism, just sit tight. We have millions of illegal aliens in our country now that came from cultures that have a very different notion of what is acceptable and what is not. I’ve noticed that leftist outrage towards Israel will frequently result in a similar situation in America that the tolerant leftist find upsetting. Those that think pastries being handed out in America following the murder of an innocent American citizen is outrageous are fooling themselves.

Lenny notes in his podcast that the arabs aren’t the least concerned about any actions the IDF may take, they view the IDF as no deterrent at all. The Jewish citizens living near by? Them they are scared of. Good.

And I haven’t even touched on the hearings going on about Covid, gain of function, the lying about cheap already available cures for it that were disregarded because if they had been put into use Tony Fauxci and his cabal of “doctors” couldn’t get the emergency use license for the experimental gene altering clot shots. The use of taxpayer money to fund gain of function, and Fauxci is still sending your money to Joe Xiden’s boss, China, I do believe. But not to be outdone, Hunter Xiden helped finance the bioweapons labs in Ukraine I think I’ve heard. Man, that would be so scary to have bioweapons labs right next door in Canada or Mexico. I mean seeing as how America handled Covid, what with putting Mom and Pop businesses out, forcing people into medical experiments they didn’t want and changing the definition of the word “vaccine”. Yeah, the way America handles that stuff would be enough to make any government a bit concerned, shall we say.

My point is this, the current federal government, and some state governments hate us, U.S. The federal law enforcement agencies under the misnamed DOJ, hate us. And I think if I’m intellectually honest with myself, I need to admit it. I’m not saying we can do much different at this point, unless you have a Congress Critter or Senator that is willing to listen, and then ask for the FIB, ATF to be de-funded and dis-banded. At this point to not do so is like voting to keep the brown shirts (and I don’t mean UPS) around. They offer nothing of value to the average law-abiding citizen.

I would maintain the appropriate response to these atrocities is hate. They do hate us, and they are willing to kill us. You could ask Roseanne Boyland or Ashli Babbitt…but.

Just as the idea of fighting back when attacked has been taught out of school children, the notion of appropriate hate is not really in our culture I don’t think. The things the left calls “hate” or “hateful” is usually free speech, or saying something they don’t like. Or giving evidence or showing video that destroys a leftist narrative. The left (demoncrat and RINO) is terrified by the thought of putting information out and allowing people to form their own thoughts and opinions. That is something they can’t abide.

There is a time, when hate is the appropriate response.

U.S. District Judge Brian Wimes ruled the 2021 law is preempted by the federal government under the U.S. Constitution’s supremacy clause.

“At best, this statute causes confusion among state law enforcement officials who are deputized for federal task force operations, and at worst, is unconstitutional on its face,” Wimes wrote.

Unconstitutional federal laws take precedence over constitutional state laws.

Lessee… Yep. Wimes is an Obama appointee.

Non-Citizens And Gun Control

I made a bet with myself: Most folks seeing that title probably thought I’d be talking about illegals. Nope. I’m talking about another class of non-citizens in America.

No, not green card holders either.

David Codrea wrote a column about a recent DOD report on suicide prevention in the military.

That means focusing on guns, and considering that’s what the majority of service suicides use to end their lives, that’s understandable. What’s arguable, though, is whether putting the major emphasis on means neglects the important questions of “Who?” and “Why?”

David covered the topic fairly well, so I won’t rehash it all. TL;DR: It calls for lots of gun control for military members.

But it — the report, Preventing Suicide in the U.S. Military: Recommendations from the SuicidePrevention and Response, not David’s column — struck a nerve. It reminded me of why, when I was in the service, I hated the term “citizen soldier.”

Citizen soldier always meant “National Guard.” We’d hear it  when Guards showed up for their two weeks, and even more during retention briefings. No one wanted to hear, much less answer, my question of, “Aren’t us active duty regulars citizens?”

That suicide report makes it very clear that they are not. Otherwise, it might take some notice of BRUEN. It might have considered that basically every restriction they want to inflict on service members runs afoul of the SCOTUS ruling. Bear in mind that all these are about privately owned firearms, even if they are never brought onto government property.

It has it all. Firearm registration, commander’s permission to purchase, mandated “safety” training, waiting periods.

And raising the age to purchase/possess to 25 years old.

Everyone one of those is in trouble in federal courts… for citizens. Especially that 25 year minimum age limit.

25… By the time I reached 25, I was already a Staff Sergeant and NCOIC of a base-level shop managing multi-year, multi-million dollar programs. But, apparently, I was too young to be trusted with a gun. Except the gov-issued, full-auto assault rifles.

Of course, that was then, and not the present day Air Farce that’s lowering standards, and actively recruiting the physically and mentally disabled.

I strongly recommend that the military return to recruiting high quality personnel and treating them like the citizens they are. Yes, military service has some requirements that civilians don’t have to deal with; and that sometimes requires some adjustments to how human/civil rights are respected.

But service members still have those rights, and the DOD would do well to accept that.

And in the meantime, the DOD could try another “study” to see who, and why, is most at risk for suicide; instead of blaming the gun and not the actor.

It isn’t as if that worked any better with criminals vs. guns.

Texas To Raise Firearm Purchase Age?

That’s what state Senator Roland Gutierrez wants to do.

Gutierrez started the conference by stating that he is not looking to take guns away; rather he wants the state to raise the age requirement of those who can purchase firearms from 18 to 21.

Given the BRUEN test of general historical tradition, that is likely to backfire on him. The general (federal) tradition at the time was The Militia Act of 1792, which specified:

“That each and every free able-bodied white male citizen of the respective States, resident therein, who is or shall be of age of eighteen years, and under the age of forty-five years (except as is herein after excepted) shall severally and respectively be enrolled in the militia”
[…]
“That every citizen, so enrolled and notified, shall, within six months thereafter, provide himself with a good musket or firelock

18 year-olds must be armed. So raising the age won’t fly. And federal courts are beginning to agree.

The “backfire” part lies in the current law, 10 U.S. Code § 246 – Militia: composition and classes: “able-bodied males at least 17 years of age“.

Seventeen year-old males are in the militia.

Should Gutierrez’s proposal pass and be signed into law, court challenges — under BRUEN precedent — are very likely to force lowering the minimum age to purchase a firearm.

I think his other bills — safe storage, ammunition background checks and registration, liability insurance, etc — should also be reexamined in light of BRUEN. I think you’ll find Associate Justice Thomas’s words on surety interesting, when considering the liability insurance proposal:

…the surety statutes presumed that individuals had a right to public carry that could be burdened only if another could make out a specific showing of “reasonable cause to fear an injury, or breach of the peace.

The closest thing to firearm liability insurance only began happening in the mid-19th century, and then only for those against whom a credible and specific showing of a threat had been made (take note of that for “red flag” laws, too).

In case you wondered, Gutierrez is a Dimwit-ocrat; adf the Dims are being very slow to catch on to the nuances of BRUEN, and the new original playing field.

There’s One Group Of Gov Types Without Sovereign Immunity

This is a day for good news.

Florida has a state preemption statute: firearms regulation is the provenance of the state, not lower level local jurisdictions. Even better, Florida law includes significant civil penalties for hopped up local politicians that try passing their own little gun control laws in their little ponds.

Naturally, they don’t like that. What? Hold us responsible for breaking the law? We have sovereign immunity!

Today, the Florida Supreme Court disagreed with the wanna-be lawbreakers.

The imposition of these civil statutory actions for violations of the Preemption Statute does not violate governmental function immunity. It is not a core municipal function to occupy an area that the Legislature has preempted, and local governments have no lawful discretion or authority to enact ordinances that violate state preemption. See Fla. Power Corp., 579 So. 2d at 107 (“While the authority given to cities and counties in Florida is broad, both the constitution and statutes recognize that cities and counties have no authority to act in areas that the legislature has preempted.”).

Accordingly, we conclude that the First District did not err in concluding that governmental function immunity does not prohibit the statutory actions in section 790.33(3)(f).

III. CONCLUSION
For the reasons explained above, we conclude that neither legislative immunity nor governmental function immunity prohibit the statutory actions and penalties in section 790.33(3)(c), (d), and (f). Accordingly, we approve the First District’s decision in City of Weston.

Anyone stupid enough to try passing local gun control laws in Florida now definitively faces fines up to $5,000, and damages up to $100,000.

Best of all:

public funds may not be used to defend or reimburse the unlawful conduct of any person found to have knowingly and willfully violated this section.

Violators are out of personal pocket for those bucks. Not the taxpayers, not the city’s insurance company.

At the close of Hannukah, and other things

After reading the comments on the last column, and different things I’ve listened to, or read the last couple of days, there is one more column left for Hannukah 2022. Again, I have no explanation, it’s just there and I’m sharing it. I promise, this is the last one (I’m pretty sure because this was the last day of Hannukah).

Before the actual battles of Hannukah, which attempted to eradicate the Jewish presence there was the spiritual battle to eradicate the Jewish presence. Not by killing the people, which came later, but by killing Judaism. I probably should have put a trigger warning on this column, so consider this it. Not the first time I’ve grabbed the 3rd rail.

This is where I think we are now. In the part where “The World” tries to eliminate religion, and this time it’s the presence of G-d. I would maintain the world has always tried to eliminate the Jews because they were the ones that were tasked with bringing the knowledge of G-d into the world. As people we have free choice, free will. We can choose to pick the things of pleasure and short term gratification in the world, or we can choose to follow the laws of G-d and his plan for a beautiful world. It’s like looking at architecture plans to me, I don’t read them so I can’t see how they work to make a beautiful building until much of it is in built and in place. But the plans were laid it out all along. Yes, that deck off the 2nd floor bed room sounds like a great idea and like lots of fun, especially when the hot tub was added in, but if the original plans didn’t account for it and the support for it wasn’t there in the plans, it won’t play out well. The same with how choosing what seems like a pleasurable choice at the time, may have consequences. Be it three pieces of fudge truffle cheesecake or a third beer or the junk Hollyweird puts out. But if only good is offered or available, how is that free will? Our fight with our more carnal desires allows us to sharpen our spiritual ones.

The battle today is “The World” against traditional families. A girlfriend and I were texting the other day and she made a comment of something her grandma used to say; as the family goes, so goes the country. I think it takes about 1 second to see that Hollyweird and mainstream media have had the traditional (according to G-d’s plan) family under attack for years. We’ve never had such gender confusion in our children, we’ve not seen women discriminated against openly for years until the trans-woman became far more important that stock from the factory woman. For evidence I only need point to the man swimming as a woman Lea Thomas because he’s such a loser he couldn’t succeed as man so he chose and easier way. When women have showed up to protest against things like men in women’s changing rooms they’ve been physically attacked by trans women. And apparently that’s fine because there is no outrage. But their fight isn’t with me, it’s with G-d.

I became suspicious of the sudden switch of the media from covid covid covid death death death vax vax vax to Ukraine Ukraine Ukraine very early on, because it was following the same pattern. As I’ve mentioned more than once, the citizens of the Donbas voted to rejoin Russia with darn good reason, more than once they’ve voted like that. And while “The World” and the U.S. media simper on about rigged elections I think the coverage of the faux elections in Arizona and the resulting lawsuits should pretty much stamped paid to any credibility to that claim. They could care less about the honesty of elections. The Donbas voted with paper ballots into clear cubes so people could see what was put in. I realize counting is a question, but monitors on the ground have said it was run better than U.S. elections. I know, that doesn’t take much these days. So is a first grade raffle. Run by the students. We’re coming back to this shortly.

And now Americans struggle to heat and eat and survive in the global warming ice freezer.

Which brings me to my next point. Religion. As we discussed in my last column, there are woke in every brand of religion, and we discussed Judaism’s. But Christianity has their woke pastors as well. Someone sent me a meme of a “Woke Pastor” costume for halloween with white skinny jeans, I think a gold chain and maybe some CDs and a Starbucks cup with a picture of some kind of goddess on the front. I don’t think I saved the meme though. In the war for Independence, it was the Black Robe regiment that helped win the war. This is well worth listening to at about 10 minutes long.

Many of our nation’s laws came from G-d’s law, and woke spiritual leaders of every brand ignore and dismiss that. How are they fit to lead and teach? Our rights come from G-d, the politicians are to follow the Constitution which enumerates them and is to protect them, it doesn’t bestow them. G-d did. How are there to be good, healthy and moral families when the spiritual leaders as well as elected ones let us down and in fact attempt to deceive?

So back to Ukraine and Russia. My heart hurts for the Ukrainian people. They have been betrayed in the deepest sense of the word by so many.

Ukraine has been a money laundering operation for demoncrats and corrupt republican politicians for years. The CIA arranged regime change in Ukraine under Barry Sotero, and the U.S. has bio-weapons labs there that are funded by taxpayer dollars while they most assuredly do not want taxpayers to know what is going on in them. Zelensky is locking up political opponents, shutting down news media critical of him, shutting down and banning churches and their leaders and seizing their properties and demoncrats and worthless republicans jump for joy and call this democracy. Tells you about their mindset. All done with out tax money no less. The politicians of all nations and brands are more than willing to fight to the last drop of Ukrainian blood.

I find I often get news that is pertinent from other countries rather than American sources, so these next couple of sound clips come from Israel.

First, Zelenksy doesn’t take this “war” seriously. Oh yes, he takes the money, seriously, he takes lots and lots of American taxpayer dollars shelled out by human pieces of excrement like the murder turtle, Roy Blunt and Jerry Moron. Money taxpayers won’t have to pay for heat, food, or fuel. Money we won’t be spending on our border, because we are spending in Ukraine. Money we don’t have to pay our National Guard soldiers, because we are giving it to Ukraine. This war time situation is so serious, that Zelensky did an episode of Letterman, in Ukraine. But I’ll let you listen to part of this episode of “Lighten Up”. I’m trying to start it at 18:50 seconds into the show. The relevant part only goes to about 23:30, so not that long. But worth listening to their take.

So, how’s Ukraine handling their war? And this is just till November of last year.

2. March 2 – Ukrainian air defense shot down a Romanian military transport helicopter Mi-8, which flew out to look for a MiG-21 fighter shot down by Ukraine.

3. March 3 – Estonian bulk carrier Helt was blown up by a Ukrainian naval mine off the coast of Odessa. Four people are missing.

4. March 10 – Ukrainian UAV Tu-141 “Swift” attacked Zagreb. Luckily, no one died.

5. March 13 – Ukrainian Volkssturm shot down the car of an American journalist from the New York Times, Brent Reno, in the Irpen region, who, according to Iranian intelligence services, worked as a CIA officer in Iraq.

6. September 9 – a Romanian minesweeper was blown up by a Ukrainian naval mine near Constanta. Luckily, there were no fatalities.

7. November 9 – A Turkish boat was blown up by a Ukrainian naval mine off the coast of Turkey. Luckily, no one died.

8. November 15 – The Ukrainian S-300 air defense system attacked Poland, destroying 2 Polish citizens and a tractor trailer.

Under the guise of a war with Russia, Ukraine is waging a hybrid war against NATO!

Which bring us to my distrust of the attacks on Russia and Putin early on. For one, I’ve heard from more than one person that Putin has been decent (the comment good was used a couple of time) for the Jews. I have no personal knowledge, so that’s hearsay, but it’s hearsay from people that personally know. Human piece of excrement Lindsey Graham came flat out and said the war in Ukraine is about deposing Putin and regime change in Russia. No mention of what happens when someone else, and possibly less stable than Putin gains control of all those nukes.

You know, it’s fascinating. The Xiden regime is so worried about Israel electing what is suppose to be a right wing government. They’ve even tried to forbid certain Israeli politicians (whom I happen to like) from serving in the government. I guess they are afraid they might allow Jews to pray on the Temple Mount. Something which the courts have said is legal. The Xiden regime claims they are afraid Jews praying where the Holy Temple once stood, where G-d calls us to pray, will start a war. But the Xiden regime has no problem poking that big furry nuclear clad Russian bear directly by attacks on their pipeline or indirectly through their CIA puppet Zelensky.

But why? Why these attacks on Russia? Again, another Israeli podcast. This one covers some Hanukkah history you may (or not) have heard before, and of course it’s fascinating. But I especially think one of the comments made in the podcast have the answer to my question. It involves Christianity more than Judaism really, and Russia.

I’m trying to start this at 42:46 into the show.

This actually makes sense in a way to me. There has to be another reason other than “Putin bad”. Look, there’s lots of bad rulers out there. I’m sure many of them are supported by U.S. and put in place by the FIB and the CIA. But apparently, Russia is Christian, at least more so than many other nations. Is this what’s behind “The World” turning against Russia? We are in the spiritual battle of Hanukkah where the general shows up in Modi’in and demands they sacrifice an unclean animal on their alter. The spiritual battle before Mattias picks up his sword and says “Oh HELLinized NO”. The Judah battle came after.

REBEL! Fight back! Have strong, healthy loving families. Raise them with the principles of your faith, raise them to understand, not just recite strong conservative values. Think twice before you send them off to the communist creation centers known as college and university. Observe and love your family Shabbat/Sabbath. Pigpen, I have thought much about your comments on my last column. My idea of marriage was always a partnership. Someone with whom you had common goals, beliefs and principles, a moral compass if you will. Someone who picks up your weak points and you shore up theirs. Someone who can (though I’m sure it doesn’t always work out this way) be a safe port in the storm called life. Someone you want at your back. Your message was so beautiful, inspiring and clear. May G-d bless you and your family, even more. The dating advice my cousin gave me was “Pick someone you want at your back during the zombie apocalypse.” He said after seeing his wife at the range, he was convinced he had chosen well. Actually his advice isn’t far off or bad.

In these times, when we’ve been betrayed by so many institutions that should have had our backs, I just think about this meme I got this morning. A tip of my Stetson to Mike.

Troll Report

TZP recently had a visit from a troll. “Allan” claimed that Congress has the power to impose whatever gun control it wants via Article 1, Section 8 of the Constitution, because it has the “power to regulate the “Militia”.”

If that’s all there was to it, I would — and did — note that his reading of the Constitution was incomplete, that Congress only has that power over “such Part of them as may be employed in the Service of the United States.” Congress gets to regulate only those called up for federal service; something that hasn’t happened lately.

However, “Allan” also chose to denigrate Americans as “nuts, “fans”, and “paranoid yokels.” In addition to my reply, he earned a flag for future moderation. Sadly, that flag was needed. He came back.

…to dismiss the limitation of regulating only those called up as a mere “red herring,” and insist Congress can “regulate” all the militia all the time, called up or not.

Organizing, arming, disciplining, governing: ‘Tis the stuff of top down, centralized regulation.

Spoken like a true authoritarian statist thug. But that’s not how the American constitutional republic is supposed to work. Limited powers were delegated to the federal (“central”) government, with the rest retained by the individual people and states. The people then decide who goes to the federal government. And once there, even those delegated powers are constrained by the Constitution (most notably, see Amendments Nine and Ten).

We could have agreed to politely disagree, but “Allan” couldn’t leave it at that. He declared that somehow Article VII defining when ratification occurs invalidates the Constitution… because it…

pretends to tell you all about an important area of law before it has become law, so A7 doesn’t even belong in the document.

I wonder if “Allan” has ever signed so much as a rental contract, and noticed that effective dates were included on the paper before he even signed it. Or if he’s read a bill in Congress that includes an effective date

But this brings us to just why “Allan” was flagged for moderation.

If a sustained fresh breeze of these self-evident truths were to blow through the USA’s law schools, it would set in motion a windmill of genuine, grinding change needed to rid the Earth of this dangerous abomination. Signs are good at places like Yale that students’ minds are becoming prepared for that breeze. When it comes, you may know that the USA has only a few more generations of aggression left in her before her death and decomposition.

That sound remarkably like someone advocating for overthrowing the US government and Constitution. Fortunately, the Constitution — flawed as it is, it’s what we have to work with — has an enforcement mechanism.

The Second Amendment. “Allan’s” army of Yalie lawyers might discover that a hundred million armed Americans object to their destruction.

That would be enough to get “Allan” blacklisted here. But he decided to make sure of it.

And, yes, it’s fair to describe many Americans as fans, nuts, and yokels. Plunderers, bullies, liars, ideologues, massacre specialists, and bigots, too. So when you see “USA”, just know that A stands for the holes at the end of Americans’ alimentary canals, esp. when found on the bodies of lawyers and their most lucrative clients.

Good riddance, “Allan.”

Voluntary Forfeiture Of Second Amendment Rights

Democrats have pushed yet another troubling gun control bill through the House Judiciary committee, setting it up for a floor vote. The bill is H.R.8361 – Preventing Suicide Through Voluntary Firearm Purchase Delay Act.

This proposed law would create a new NICS database of people prohibited from obtaining firearms. Not criminals, or those adjudicated mentally ill; it’s to be a database of those stupid enough to voluntarily surrender their 2A rights. OK, perhaps those crazy enough to beg Daddy Government to protect them from themselves should not have guns. But you won’t see me “volunteering” for this. More on that point in a moment.

First off, the bill’s name — Voluntary Firearm Purchase Delay — is an outright lie.

When an FFL makes the NICS call, and the feds find your name on this list, the dealer is not told to delay the purchase. There’s no waiting period. It’s an outright denial just as if you were a convicted felon; the dealer is to be told that it would be unlawful to transfer a gun to you. Which is probably exactly what the dealer is going to assume (and might even call the cops on you).

And it would be unlawful, because this bill amends 18 U.S. Code § 922(d) to add voluntary idiots to the list of prohibited persons.

Personally, if anyone had asked for my input — and persuaded me that any such law was necessary (ha!) — I’d have gone a different route: Instead of adding suckers to the prohibited list and issuing denials, the dealer would simply be told that the would-be buyer requested that he not be allowed to buy a gun. Then it would be up to the FFL to decide, with specific language exempting them from any liability for not violating the buyer’s 2A rights.

The next issue is how one would get into that database. There are two ways.

First, fools can present a gov-issued photo ID in person (“where” isn’t explained), and give up their rights.

Secondly, someone can email a copy of a driver license along with a letter from a mental health professional that includes the “name and license number of the professional and the name and date of birth of the individual.”

Maybe I’ve got a couple of ‘noids showing, but…

Who has a copy of your driver license? Did the bank make a copy when you opened your account? Did some online or brick store make a copy when you bought an age restricted product? Or maybe an employer (or potential employer) wanted a copy to comply with E-Verify. I’ve done all of the above.

Just imagine someone with a copy and a grudge… maybe against you, maybe the 2A in general. They’ve got your name and date of birth. But that darned mental health pro’s name and license number…

I did one single web search, taking less than 30 seconds, that gave me the name, address, and license number of a random clinical psychologist. Problem solved. Interesting what you can find online; it’s probably good that I try to be an honorable person.

Another interesting point: When you — or some less than honorable scumbag — requests that you become a prohibited person, you/him can include up to five email addresses to be notified if you do attempt to buy a gun, or try to get off the naughty list. Maybe even “registry@atf.gov.”

Getting off said naughty list sounds simple enough. You just make the request — with the same documentation that got you on it — and the feds are supposed to remove you.

Three weeks after they acknowledge receiving your request. Maybe that is the “delay” they meant.

Or you can look up a mental health pro as above, and fake the letter. That’s supposedly going to get you out of the database in 24 hours. Lemme bookmark that psychologist I found…

Frankly the only good not as horrible part of this is that database victims are only prohibited persons under 18 U.S. Code § 922(d), not section (g). So you won’t instantly make yourself (or someone else) a criminal simply for currently possessing firearms. Unless they tack on an amendment.

Now for the bad news. I think this garbage has a fair chance of passing. H.R.8361 had two original sponsors; one a rabid Dim-wit as you should have expected, and one Repugnantcan. As you also you should have expected. Reps tend to like infringements for “law ‘n order” and this is only “voluntary.” If the Dims can move this to the floor and force a vote this session, before the new Rep bare majority takes over, it’ll go to the Senate, where…

And then what other rights will they look at “voluntarily” criminalizing?
