Not Seeing What One Doesn’t Want To See

We must do something to stem this wanton bloodshed
Please make them stop.

I’m talking about the wanton, reckless firearm slayings that happen too often in Virginia and around the country. The victims and killers are disproportionately Black men.

So far, Mr. Chesley is correct, at least according to the FBI’s Crime Data Explorer. Anecdotally, based on decades of media reports, I concur. Blacks are disproportionately committing crimes, and being victimized. One — and Chesley does — wonder what causes that. How do we fix it?

Chesley’s answer is…

Guns. Too many guns. Easy access to guns.

Of course, it is. [-roll eyes-]

To me, based on the data, news reporting and other observations, it seems a three-pronged approach is necessary if this nation will ever significantly lower firearm deaths:

  • Use the research on guns, mayhem and intervention that is widely available; more than 1,400 violence prevention studies have already been done.
  • Do better at stopping guns from getting into the hands of criminals and would-be criminals. More than 73 percent of the homicides for which the FBI received weapons data in 2019 involved firearms, the agency reported. Handguns comprised 62 percent of the firearms used in murders and nonnegligent manslaughters in 2019.

If the guns are the cause of the problem, why are black men disproportionately using the guns, and disproportionately on each other? According to Pew:

And while 36% of whites report that they are gun owners, about a quarter of blacks (24%) and 15% of Hispanics say they own a gun.

Whites, particularly white males seem to disproportionately own guns. If Chesley’s thesis that guns are the problem held true, then offenders and victims would be disproportionately white, not black.

The reflexive response, by those with a vested interest in funding to study the problem — as opposed to fixing it — is to blame inherent, systemic racism that somehow causes those blacks to be involved in crime. That is both simplistic and wrong.

Per this study, 23% of blacks have felony convictions. That’s unfortunate, but looking solely at that number ignores a much happier fact: The vast majority of black — 77% DO NOT have felony convictions.

That would seem to rule out systemic, keep-the-black-man-down racism. Once more, if that was the problem, it wouldn’t only be holding down one small portion of the population.

Perhaps you noticed that I left out Chesley’s “third prong” in his approach. Third; apparently less important, less pressing and blaming guns.

  • Instill into young men – overwhelmingly African American – a respect for life and a determination not to use guns to settle arguments. (Why so many believe America devalues them is a discussion for another day. Many young Black men, though, can’t envision a productive or equitable future.)

Finally, he is on the right track. Sort of. Instead of comparing white vs. black crime and victimization rates (and leaving the damned guns out it), what needs to be studied is why the majority of blacks are not criminals. What differentiates the 23% from the majority 77%? Why does that small subset lack that respect for life; why does that small subset lack that vision?

I have my own suspicions, based on personal anecdotal experience. One productive neighbor is a college graduate; I know he has a clean record because a felon cannot be licensed to do the job he held.

The neighbors on the other side of me are likewise fine, decent people. In fact, when I had my accident last year, A—- was one of the first people to rush to my aid. She was also the first to rush to hug me when she saw me finally walking without a walker (I was still on a cane).

The common denominator for these people, whom I cannot imagine turning to a life of thuggish crime, is family. They have intact families with whom they are in contact. Families that taught them to be decent people, and self respect that allows them to respect others, as well.

If Chesley wants to fix the problem, he needs to find a way to instill that same kind of respect in that small group that lacked that advantage in their youth. But that’s going to be a lot tougher than just blaming guns.

It could be done, but implementing it — three easy lessons — requires courage.*


* For the record: I do not think that anyone in a position to begin implementing my suggestions has the inclination or courage to do it. Nor do I think that anyone with said inclination and guts will be allowed to achieve such a position any longer. Hopefully, someone will prove me wrong.

Covid Trials (and Tribulations)

So my 93 year old Mom went to the Big City Medical Center on October 3rd, her 93 birthday, September 28th, was spent in her small apartment with her double injected and recently boosted younger sister and her daughter (Mom’s niece) a few days later she had a cough. For all my life I will regret that I was starting a 3 in a row stretch at work. Two days later she was taken to Big City Medical Center with WuFlu. The only good thing I can say about Big City Medical Center is they allowed one visitor a day for one hour.

My Aunt, not Mom’s sister, my Dad’s sister, lives a couple of floors up. They usually eat their meals together in the dining room. The day Mom’s younger sister came to visit with her daughter for the day my aunt came down and ate with them, then went back to her own apartment so she wasn’t around them that much. To my knowledge, no one else in the building has developed WuFlu within a close time frame. Neither Mom or my aunt are injected for different reasons. And since part of the people I take care of are double injected and boosted and I’m still taking care of them tells me enough. So what I’m saying in a round-a-bout way here is yes, I think Mom’s sister and her daughter shed their little spike proteins all over and Mom caught it, and yes that’s a real thing. Ignore the snopes one, they’ve been debunked as a website fact checking service. Then there is this

So on to Big City Medical center the ambulance took her. I had to work that night, but was able to see her the next two days. I politely asked about using Ivermectin and was told they tried it, it didn’t work. I asked them if they knew what they’d done wrong? Considering India’s incredible success with it. But India and Japan are far from the only countries using Ivermectin early to beat WuFlu.

But ideally, Ivermectin is administered early in the disease. For example when patients first come in the ER with it, rather than being sent home and told to take tylenol and come back if they can’t breath they should be given a script for Ivermectin or Hydroxychloroquine and zinc and told to hit the vitamins. But noooooooo. Which is not to say it won’t work if given later in a hospital setting.

And believe it or not, in addition to some very brave doctors and nurses who are fighting for their patients at great personal risk, I might add, are lawyers! And why on earth do we have to go to court to try a perfectly legal medication that is on the NIH web site of approved for use meds?

Who would have thunk it, lawyers that are fighting harder to save patients than some doctors.

So while Mom was in Big City Medical Center, I did not want her on Remdesivir, they aren’t going to give Ivermectin, but I don’t want her getting Remdesivir. They gave her Remdesivir. I asked the nurse taking care of her that day as we talked on the phone if they weren’t concerned about my diabetic, congestive heart failure Mom’s kidneys? No says she, “We’re giving her Lasix”. It was all I could do to keep from saying “Well, aren’t you the stupidest little cow in the pasture”, but I’m trying hard to do better. Yes, Lasix will make her pee and do not a dang thing to protect her kidneys from the damage caused by Remdesivir.

Every single thing Big City Medical Center did to my Mom was according to the Fauxci protocols. May he be swinging from a rope soon as the others who perpetrated medical experiments on unwilling subjects did. Nuremberg 2.0 can’t come soon enough. But back to Big City Medical Center, they followed the protocol to the letter. No Ivermectin, yes Remdesivir. Mom occasionally has a cough, she did before WuFlu and asked for sugar free honey lemon cough drops. I asked the nurse if I could bring some in. She said she would ask the doctor. I sat there and thought “Awesome! All those years of medical school, the mountain of school debts, the sleepless nights and your sole choice is now can the patient have a sugar free lemon cough drop. Wow, Fauxci has really destroyed the practice of medicine.”

Don’t even get me started on them whacking her with Zyprexa. Yes, it has it’s uses, but right patient, right dose is kind of important. If what you gave your patient makes her unresponsive for 3 days, you screwed up. Pro-tip? Don’t attempt to prove the patient is indeed responsive by pinching the webbing between her thumb and finger under the bed cover and when she grimaces and withdraws her hand try to tell the daughter sitting there you didn’t that you were just “stroking her hand”. I’ve been in the game longer than you’ve been alive bitch. I know what “responsive to pain” is.

I realize this column is more disjointed than usual, but should you or someone you care about wind up in “Big City Medical Center” I want to pass a few useful things along. Although I’m pretty sure this won’t be the last column dealing with WuFlu, because, you see that is the tool to enact the tyranny. The more information we have, the more ammunition we have to counter. Sometimes.

So I have no idea what happened to the first part of this column. YESH, here is the missing part. But honestly, after I put this up, I found some more things to add in. Still don’t know how I managed to lose the first part.

Sometimes it can seem like everything in the deck is stacked against us. U.S. We’ve got a piece of crap dementia ridden head of a crime family occupying our White House. Elections have consequences, stolen elections more so, eh? We have “intelligence agencies” that need to be called something else. I have lots of helpful suggestions, but that’s not what this column is about.

This is about fighting back. There is something going on all across the world right now. People are waking up to the evil that governments have decided to impose on their serfs. It seems to me that people are picking what they feel most strongly about and standing up and fighting back. Some of them very eloquently.

So let’s take a look at some current events and draw hope, shall we?

First up, the Germans have had enough of the tyranny imposed by their government; mask mandates, lock downs, do this, don’t do that.

Speaking of students, a whole lot of parents have flat had enough of the “woke” “progressive” agenda of turning students into future Communists. And then the parents showed up at the school board meeting….he’s fired. They wanted him out right now, not in a week, two weeks, whatever.

But it’s not just antifa teachers, and actually I bet there are more of those than we could imagine. It’s Critical Race Theory. And parents have had enough of it. They are showing up at school board meetings like never before. Apparently a lot of parents were like mine, who thought they could trust the educational system. Back in my day, they probably could without too many repercussions, but not so today.

Isn’t it weird, a year ago when there was no injection it was “Healthcare heroes”, “Frontline workers” now doing the exact same job, wearing the same PPE (personal protection equipment) for some reason hospitals are so frantic to get this substance into their former “heroes” they will fire them if they don’t submit. Guess all that “essential” stuff was B.S. right? Kind of weird isn’t it, one would think that hospital workers, especially the frontline variety would be begging for the injection. Yet, they aren’t. Wonder why that would be. And many that have taken it were threatened, or bribed with chances to enter lotteries with thousands of dollars. You know, like every other injection in history for a disease with a 99% + survival rate. Sorry, I got off topic there. Anyway, they aren’t sitting down and taking it quietly either!

People are running for school boards and local offices, they are showing up at political meetings and forming citizen groups, and I don’t mean “Republican clubs”. Going Retro

You know, I really like the fashion of the 1930s. I feel they were very classic, flattering and stylish.

And there were some great old movies in the 1930s. Among them: Gone With The Wind, King Kong, Pygmalion, Robin Hood, Stagecoach and of course, Mr. Smith Goes To Washington.

I think we need another Mr Smith to head to Washington DC STAT, as in January 20th.

While I love the fashion and movies of the 1930s, I am not loving the feeling of living in 1930s Germany. And I think we are.

The obligatory disclaimer, I’m not a doctor, I’ve never played one on TV, heck I didn’t even sleep at a Holiday Inn Express last night. But I do know a bit about medicine.

Once upon a time, if you went to a doctor about an illness, and you got bad news, or you just weren’t sure you completely trusted his opinion, you would get a “second opinion”. Some doctors even encouraged it. The same with lawyers, if you didn’t like what one had to say, consult with another one. Those days are gone. Now there is only one medical opinion allowed, no dissent will be tolerated and if you do so you risk your medical license. I also wonder why we bother asking anyone if they have any allergies, because hey, all bodies are just alike, right?

Almost all the control group were then given the vaccine.

Florida Students Placed in Isolation or Quarantined Over New COVID-19 Protocols

As schools reopened in Florida, several parents in Flagler County received weekend phone calls saying their children were on “a list” because they “may” have been exposed to someone who “may” have had COVID-19. Some parents were told their children could not return to school until they passed a series of COVID-19 tests. Other children were pulled from class and placed in isolation while parents were called and told to come pick them up “immediately.” The process has caused confusion and raised legal questions, leaving many parents feeling very angry.

On Aug. 8, Jessico Bowman—a director of the Florida Liberty Caucus—received a call from a person who claimed she was from the “health department.” She would not give her name. Nor would she identify which “health department” she represented.

“I regret to inform you that your daughter may have been exposed to COVID,” the woman said.

“I don’t have a daughter,” Bowman told the woman. “I have a son.”

The shielding approach aims to reduce the number of severe COVID-19 cases by limiting contact between individuals at higher risk of developing severe disease (“high-risk”) and the general population (“low-risk”). High-risk individuals would be temporarily relocated to safe or “green zones” established at the household, neighborhood, camp/sector or community level depending on the context and setting.1,2 They would have minimal contact with family members and other low-risk residents.

Current evidence indicates that older adults and people of any age who have serious underlying medical conditions are at higher risk for severe illness from COVID-19.3 In most humanitarian settings, older population groups make up a small percentage of the total population.4,5 For this reason, the shielding approach suggests physically separating high-risk individuals from the general population to prioritize the use of the limited available resources and avoid implementing long-term containment measures among the general population.

How A Republic Dies

Long ago, in the year 1787, a tribe known as Gardenites dwelt in the lush valley Arboretum that provided all their needs. Growing in its midst was a tree named Liberty. Inscribed on its sacred bole was General Welfare, a list of powers delegated to Arboretum’s government they called Steward. Only one piece of fruit grew from this tree. Because it contained the seeds of Liberty’s renewal, Gardenites prohibited anyone to eat it. Even though they lived in paradise, some residents began imagining how they could make Arboretum better, if they were charge. Instead of limiting Steward to only protecting Liberty, the imaginers, called Consolidators, would grant him unlimited power to reorganize and reorder life in Arboretum according to their vision for how it should be run. When Consolidators made their proposal to the Gardenite Assembly, they in turn consulted Liberty. General Welfare forbade Steward from taking any action not on its list. Finding no authority for the proposal, Gardenites voted no. A silver-tongued man named Beguile led the Consolidators. His manners were serpent like; his clothes shimmered as if gold. Words flowed from his sibilant tongue like honey as he promised Gardenites a life freed from toil and a cornucopia of plenty for all if they but ate the fruit of Liberty. Seduced by Beguile, Gardenites took and ate the fruit. With the last seed consumed, the words inscribed on Liberty faded, dissolved, and blew away like dust. Consolidators, whose desire was to rule over all Gardenites, seized control and became Steward. Soon briars and thorns grew up among the crops making harvests meager. Rains ceased, the ground grew parched and cracked, and crops began to die. Steward beat the Gardenites to work harder, taking the first portion of each harvest to share with obedient followers. They raided Gardenite homes for items of value they dispensed among themselves. A great sound rent the air. Liberty cracked, split asunder, and crashed to the ground. Arboretum was no more.

At this writing, Democrats and Republicans debate the size and cost of Mr. Biden’s “infrastructure” bill. Missing from the debate is the question as to whether or not federal infrastructure bills are legal in the first place. If not, arguments over size and cost are moot.

Professor Brion McClanahan writes the “general welfare” is one of the most misunderstood phrases in the Constitution. Many, if not most Americans believe it means the federal government is to provide for their material well-being. This includes food and poverty assistance, medical care, paying for college, building roads and bridges, and so forth. This results from an “incorrect reading of the Constitution” leading to approximately “90 percent of what the federal government does being ‘unconstitutional’—and it’s all due to an expansion of government power under the guise of the ‘general welfare”.3

The most important part of the Constitution with respect to the exercise of federal power are Article 1, Sections 7, 8, and 9. They comprise “the power of the ‘sword and purse” consisting of restrictive clauses relative to Congress’s exercise of power. By ill-informed and dishonest reinterpretation of these clauses, they are the mechanisms by which those in power metamorphosed a federal into a national system of government. From day one, Founders who favored consolidating power in a strong central government [Consolidationists] worked to transform the restrictive design of the general welfare phrase into a positive authorization for what they wanted to do.4

Article 1, Section 8, the enumerated powers, comprise a closed loop. The states delegated to the federal government no powers outside it. Professor Forrest McDonald notes the taxation authority of the U.S. government is limited to the common defense and general welfare. Government may tax, borrow, and spend only for what is in the enumerated powers. No authority for infrastructure, roads, bridges, canals, transportation, and so forth is among that list. The Founders rejected federal funding for infrastructure projects because the states as a whole would pay for projects benefitting only one region or locale.5

States sent delegates to Philadelphia in May 1787, to revise the Articles of Confederation. Instead, during the next several months, they drafted a new Constitution. Among the factions attending were “nationalists” who wanted to create a strong central government of consolidated powers. Consolidated from the states, which then would become appendages of the central government with no autonomy or sovereign power of their own. If they succeeded, American government would become much like those in England and Europe wherein the powerful used it as a means to promote favored regional, commercial, nepotistic, and political special interests.

Delegates may not have shared a common vision for what form the new government should take, but they did share a common understanding of the words general welfare. They “lifted” them and their meaning from the document they were sent to revise. In both documents, general welfare refers to government actions benefitting “the union as a whole such as military hardware for the common defense” but not tax expenditures or financing of projects benefitting only specific localities, regions, states, and so forth. This restriction excludes federal involvement with any form of infrastructure or its maintenance.6

In order to create a national as opposed to a federal system, Consolidationists knew they had to alter the meaning of general welfare. James McHenry, of Maryland, wrote in his journal on 4 September 1787 that under the proposed Constitution, the “national” (sic) legislature could not, but should have the power to appropriate money to “erect lighthouses or clean out or preserve the navigation of harbors”. He discussed this with Nathaniel Gorham, Massachusetts, and Gouverneur Morris and Thomas Fitzimmons, delegates from Pennsylvania. Morris said, “The Congress could do so under the ‘General Welfare Clause”. McHenry was aware such an interpretation would allow Congress to grant trade monopolies which, Southern states rejected. Benjamin Franklin also sought to circumvent the restrictive nature of the general welfare. He proposed the words “to provide for cutting canals where deemed necessary” be added after the words “post roads” in Article 1, Section 8, Clause 7. James Wilson, and the rest of the Pennsylvania delegation, supported this motion. Considering Philadelphia was a major trading port, their self-interest was obvious. Roger Sherman, Connecticut, opposed this change noting, “The expense in such cases, will fall on the United States, and the benefit accrue to the places where the canals may be cut”. Wilson countered that Sherman was not only wrong but his restrictive construction of the term constituted an obstruction of the general welfare. Rufus King of Massachusetts, a state with the important port Boston, saw the larger picture and came to Sherman’s defense. He noted Wilson’s interpretation of general welfare meant government would have authority to establish banks, build roads, and erect commercial monopolies “that would sharply divide the states”.7 Delegates voted Franklin’s proposal down. King’s comment was a foreshadowing of backroom deal making. Politicians call it “log-rolling”. Coastal states obtain federal funding for projects appropriate to their geography by supporting funding for projects in land locked regions. The general welfare prevented such practices.8 Consolidators did not give up.

Gouverneur Morris continued to insist the general welfare should allow the general government to build docking piers (infrastructure) in port city harbors. He told McHenry and Gorham delegates should promote this interpretation. “McHenry was horrified by the implication of so broad an interpretation of the clause”. Morris attempted to alter the meaning of general welfare through subterfuge. As principle penman for the Committee of Style, he wrote the Constitution’s draft. When he penned Article 1, Section 8, he “itemized the powers of Congress in clauses, separating them by semicolons. He inserted one between “To lay and collect taxes, duties, imposts, and excises’ and the qualifying ‘to pay the debts and provide for the common defense and general welfare”.9 A semicolon is a “punctuation mark; used chiefly in a coordinating function between major sentence elements (as independent clauses of a compound sentence)”.10 Morris’s alteration would have turned general welfare from a dependent phrase into a stand-alone clause transforming a restrictive into a “positive grant of power”. Congress could then do whatever it wanted. Roger Sherman caught Morris’s trick, brought it to the Convention’s attention, and they directed a comma replace the semicolon.11

Instead of a clause, the general welfare is a dependent or subordinate phrase, a distinction with a difference. Clauses are a “Collection of words that has a subject that includes an active verb”.12 An independent clause “can stand on its own” [contains both a subject and a verb] and “it does not need to be joined to any other clauses because it contains all the information necessary to be a complete sentence”. In addition they; 1) have a subject which tells the reader what the sentence is about, 2) have an action or predicate [verbs that explain or tell what the subject is doing], and 3) express a complete thought, something that happened or was said.13 A phrase is a “collection of words that may have nouns or verbals [nouns-words that name. Verbs/verbals-words that do or are].14 Dependent or subordinate phrases do not complete a thought and cannot stand-alone. For example, the words “general welfare” to a reader mean nothing. For a clause or sentence to stand-alone, it must contain a word or group of words acting as a noun and is the main-focus of the sentence.15 A phrase cannot stand-alone otherwise; it is a sentence fragment, “and is considered one of the worst writing errors one can make”.16 What does all this mean?

The general welfare is a phrase dependent on and attached to the common defense and the enumeration of powers that follow. This enumeration defines the general welfare. Infrastructure is not among the powers listed. The taxation authority of the U.S. government is limited to the common defense and enumerated powers. The federal government has no authority to appropriate money to build roads, bridges, canals, and so forth. To do so would improve the welfare of a specific area, not the nation and thus delegates rejected delegating this power to the federal government.17

When the Convention first presented the proposed Constitution to delegates in Philadelphia, the words “common defense” and “general welfare” were absent. A motion to add them was defeated. Delegates grounded objections on the fact that since Article 1, Section 8, the enumerated powers, constituted the common defense and general welfare, these words were redundant. In addition, delegates who supported a federal as opposed to national system of government, contended consolidationists would twist the meaning of general welfare to expand federal power beyond its enumeration. Roger Sherman noted these words applied to very few “objects” limited to protecting the nation from foreign powers and insurrection.18 South Carolina delegate David Ramsey agreed the Constitution confined the powers of Congress to providing for the common defense and general welfare. To raise money for any other purpose, including internal improvements (infrastructure) was illegal as those were among the reserved powers belonging to the states. Upon this understanding, delegates added the words when the Convention closed in September 1787.19

Criticisms by opponents of the proposed Constitution compelled proponents to defend and explain its problematic parts. They did this through newspaper editorials, essays, and the Federalist Papers. Madison and Hamilton, to a greater degree, were nationalists. Both considered the Articles of Confederation an impediment to creating an American nation. Both supported a national as opposed to a federal system of government. However, they understood states would not support the former because it meant relinquishing state sovereignty. Hence, they supported the proposed Constitution as a first step toward a larger goal. They conceded the general welfare did not authorize Congress to fund infrastructure. Common sense dictated states fund their own projects.20

Anti-Federalists claimed the general welfare “clause” (sic) constituted an unlimited delegation of power to the general government. James Madison addressed this in Federalist 41. He noted Article 1, Section 8, and its 18 sub-clauses comprised the sole meaning of general welfare. The list was restrictive. Congress has power to tax, borrow, and spend only for what is on the list. Most of the list comprise actions relative to the military, foreign commerce, and war.21 In Federalist 45, Madison wrote; “The powers delegated by the proposed Constitution to the federal government are few and defined. Those which are to remain in the State governments are numerous and indefinite. The former will be exercised principally on external objects, as war, peace, negotiation, and foreign commerce; with which last the power of taxation will, for the most part, be connected. The powers reserved to the several States will extend to all objects which, in the ordinary course of affairs, concern the lives, liberties, and properties of the people, and the internal order, improvement, and prosperity of the State”.22 Madison provides a concise explanation of America’s republican form of limited government and federalism. Hamilton could not help but show his true colors.

Writing in Federalist 30 and 34, Hamilton insisted the federal government’s ability to acquire revenue and spend had to be commiserate with challenges it faced especially with respect to the machinations of foreign powers. Because no one could predict the future, government’s power to tax and spend should be untethered from limits imposed by Article 1, Section 8. It was logical Congress have the power to tax and spend on any project it deemed for the general welfare.23 Jefferson and Madison corrected Hamilton noting the purpose of the enumeration was to limit Congress’s application of the meaning “general welfare”.24

Future Chief Justice of the United States, John Marshall, ardent nationalist, and enemy of state rights, nevertheless defended ratification at the Virginia Convention. He conceded an enumeration limited the powers of Congress. It had no authority to pass laws beyond that enumeration and, if it did, judges would strike them down as “void” and unconstitutional.25 Anti-Federalists were unconvinced. A critic writing as “Brutus” insisted Consolidationists would use the general welfare to transform the federal into a national form of government.26 The vote to ratify the proposed Constitution was unanimous in only three of thirteen states and was close in five others.27 Tenche Coxe, Pennsylvania delegate wrote the states had not delegated to the federal government power to involve itself in the construction and operation of buildings and canals in the States or to subsidize such ventures. Had this not been the case, the States would never have ratified the Constitution. Delegates later added the Tenth Amendment to make clear all powers the States had not delegated to the federal government, they reserved to themselves.28 This issue was bound to come up again.

In 1794, members of Congress proposed allocating federal funds to resettle French refugees from Haitian slave revolts in Baltimore and Philadelphia. Maryland Congressman Samuel Smith argued such an appropriation was constitutional. Virginia Congressman James Madison opposed the bill on constitutional grounds observing, “I cannot undertake to lay my finger on that article of the Constitution which granted a right to Congress for expending on objects of benevolence, the money of their constituents”.29 Virginia Congressman John Nicholas agreed with Madison. He proposed, instead, colleagues raise funds through a “private subscription”. Attempting to shame him, Smith said if Nicholas beheld the misery and suffering of the French refugees, he would never have made such a proposal. Backers of the bill said no money would come from the public treasury. Instead, they would subtract the amount of the appropriation from the debt the U.S. owed France from the war.30 Like lawyers then and now, they do not have to be right only have the better sounding argument.

Congressman Madison was President Madison in 1817. Congress submitted to him a bill for “internal improvements”, an appropriation for roads and canals. He vetoed it because it was unconstitutional. Madison observed in his veto message that the States delegated no authority for internal improvements to the federal government in Article 1, Section 8. Any other interpretation would mean Congress had the power to do whatever it wanted.31

Thomas Jefferson explained in a letter to Albert Gallatin, Secretary of the Treasury, (1822) that President James Monroe had “negatived” [vetoed] an “act for internal improvement” passed by Congress. The bill’s supporters claimed authority to tax and spend for any purpose they considered the general welfare. Jefferson countered that Congress did not have unlimited powers to “provide for the general welfare but were restrained to those specifically enumerated”. It was through the exercise of that finite list of powers Congress provided for the “general welfare” and the same applied to taxing, borrowing, and spending. Jefferson believed it was fortunate the bill was passed because Monroe’s veto would “settle forever the meaning of the phrase, which, by a mere grammatical quibble” [semicolon] at the end of each list or subsection, had been used by the so-called Federalists, to expand the powers of the federal government at the expense of the State’s reserved powers. “It is a mere question of syntax, whether the two last infinitives are governed by the first or are distinct, and co-ordinate powers; a question unequivocally decided by the exact definition of powers immediately following”. In his veto message of the appropriation for the Cumberland Road, Monroe asked, “Have Congress a right to raise and appropriate the money to any and every purpose according to their will and pleasure? They certainly have not. The government of the United States is a limited government, instituted for great national purposes and for those only”.32

Although dead some 24 years, Hamilton’s philosophical successors continued working to undermine the restrictive nature of the general welfare phrase by introducing bills for internal improvements. South Carolina Congressman William Drayton declared, “Hamilton’s view would make a mockery of the doctrine of enumerated powers, the centerpiece of the Constitution, rendering the enumeration of Congress’s powers superfluous. Whenever Congress wanted to do something it could simply declare the act to be serving the ‘general welfare’ and get out from under its limits imposed by enumeration”. What would be the sense of an enumeration if, by invoking the general welfare, Congress could violate any restrictions placed on its power by the Constitution?33

One hundred years after delegates in Philadelphia signed the Constitution, President Grover Cleveland vetoed the Texas Seed Bill a drought relief measure, because it was unconstitutional. He asked rhetorically, “If government supports the people, who will support the government”? It has no wealth and produces no goods. It can enlarge its role in the lives of people only by taking more of what they earn and produce reducing their freedom and prosperity in equal measure.34 He wrote in his veto message:

I can find no warrant for such an appropriation in the Constitution,

and I do not believe that the power and duty of the General Government

ought to be extended to the relief of individual suffering which is no

manner properly related to the public service or benefit.

A prevalent tendency to disregard the limited mission of this power and

duty should, I think, be steadfastly resisted, to the end that the lesson

should be constantly enforced that, though the people support the

Government, the Government should not support the people”.

Cleveland consulted the Constitution to determine if the proposed action was legal. It was not. Presidents like Cleveland, and later Calvin Coolidge, became the exception. Congressmen continued proposing bills violating the meaning of general welfare. Presidents from Theodore Roosevelt, Woodrow Wilson, and Herbert Hoover participated in undermining federalism, the basis for a government of limited powers. Franklin Roosevelt turned a drip into a flood.

Although the Supreme Court in United States v. Butler (1936) struck down Franklin Roosevelt’s Agricultural Adjustment Act, it nevertheless held that under Article 1 of the Constitution, Congress had broad powers to tax and spend for whatever it deemed the general welfare of the nation, what Hamilton always wanted. Looking back in 1945, Chief Justice Owen Roberts observed that this case decided the long-standing debate between Hamilton and Jefferson over a loose versus strict construction of the enumerated powers and general welfare in favor of Hamilton.35 Although many more decisions to come drove the final nails into its coffin, on that day the Constitution died overthrown by nine men.

The States created a federal system of government. To it, they delegated power over international affairs, treaties, war, peace, and trade. States reserved all other powers to themselves. They prohibited federal involvement in any form of internal improvement. This would include dredging Boston Harbor, building bridges in Minnesota, constructing flood levies in Missouri, subsidies for Amtrak in NYC, a dam in Arizona, windmill farms in California, aid to indigent in Oregon, and farmers in Iowa, all of which it does. “The central government does not exist to provide a paycheck, a job, a road, healthcare, charity for the indigent, or a minimum wage”. The Founder’s acceptance that these are the responsibilities of states and individuals was universal. They would “not have viewed the transfer of responsibility from individuals to the government as a sign of progress”.36

Republican Senators Roy Blunt and Marsha Blackburn, Missouri and Tennessee respectively, support infrastructure projects, roads, bridges, and internet access, but not the Democrat’s bill.37 Today neither Democrats nor Republicans debate the Constitutionality of their acts especially infrastructure bills. Instead, they quibble over cost. They have abandoned federalism, the principle of limited government, and the Constitution. The liberty, property, and even lives of Americans cannot be safe under such a tyrannical form of government. When people say, “Well, at least we live in a free country” and “Land of the free, home of the brave” I shake my head at such ignorance. Like an over the hill actor, they are living on a past reputation that died a long time ago.

Georgia state House Speaker David Ralston is a useless, effing coward.

House Speaker David Ralston (R-Blue Ridge) said after the session ended Wednesday night that the recent mass shootings, including one in metro Atlanta, played a factor in his not calling up House Bill 218 for a vote.

“Frankly, I thought we needed to be very, very sensitive to any gun legislation,’’ he told reporters. “We’re less than two weeks out from two major mass killings. That heightens my level of sensitivity to that.’’

The Catholic Church has an abuse problem. This is a bad time to defend freedom of religion.

Someone said something mean. This is a bad time to defend free speech.

There are crack houses. This is a bad time to defend property rights.

Our Secretary of State violated the hell out of state election laws. This is a bad time to defend voters’ rights.

What pray tell, Mr. Ralston, do the actions of law-breaking murderers have to do with my rights? A mentally ill guy in Atlanta murdered people, so the millions of Georgians who didn’t do it should be blamed? That’s exactly what you’re doing when you decided to abandon us because someone else did something bad.

Ralston caved because he has no balls.

Purim Reflections on a country הפוך upside down

Purim started Thursday night, and continued on Friday till sunset, when Shabbat started. One of the things about Purim is we don’t listen to the scroll as mere (HAHA, mere) history, but as current, as our reality today, to see it through the lens of current events.

I listened to a very interesting podcast last week, the podcast discusses the genocide chart and points out the flaws in it. Nope, it’s not too negative, it’s too optimistic. It’s not that long, and well worth listening to.

Well, that’s not too hard. Let’s see, government that hates a segment of it’s own population and wants to kill them.

Basically, we are living under martial law, and have been for over a year. We no longer have the right to run our own businesses as we see fit, people that have had a business in their family for generations are losing their businesses and homes. The government decides whose life is essential and worthy of continuing.

You no longer have the right to redress of grievances, or even express an opinion on the past election, at least that’s how the rulers would have you believe. Don’t believe me? RUSSIA is saying that American citizens are being treated unfairly.

Quick pop quiz: Which supreme court justice served the shortest length of time? Amy Coney Barrett. Because with her and Kavanaugh (both who made so much of their faith, like Judas Pence) siding with the liberal court justices refusing to hear evidence in the election they have pretty much rendered the SCOTUS irrelevant. They will be packed soon enough. It will never be anything close to a real SCOTUS again. She carried on about how she “loves” the Constitution. Uh huh, like OJ loved Nicole. If they didn’t want to do the job, they shouldn’t have taken it.

We are deeply concerned about the ongoing persecution campaign against participants in the so-called storming of the US Capitol on January 6, 2021, and against anybody at all who does not agree with the results of the latest presidential election. US officials and an obedient media have labelled them “domestic terrorists.” By the way, did the ambassadors of EU countries or EU representatives in the US react in any way? Did they express concern about Washington’s rhetoric regarding its own citizens? No? Too bad.

The FBI has reportedly opened more than 400 criminal cases and applied for more than 500 search warrants and subpoenas for suspects; it has also brought charges against and detained around 200 people. Only several dozen defendants have been released on bail or placed under house arrest. The others are being subjected to harsh pressure, with members of their family and social circle being coerced into giving a “convenient” testimony. Moreover, people who have not even been officially charged are losing their jobs; they are being banned from social media and publicly ostracised.

Among other things, there is a question about the objectivity of the law enforcement agencies because they are essentially acting under orders and in line with the narrative of the current administration who declared the events of January 6, 2021 a riot and everybody who was near the US Congress on that day all but plunderers. Whereas in fact, the majority of those people were ordinary citizens concerned about the situation in their own country. These were 74 million voters who voted for their president and defended their views. I am using the same words that Washington has used with respect to our country.

Their protest will not just go away. You cannot just sweep discontent under the rug. Even the rhetoric that the United States allows itself to use with respect to Russia will not help distract public attention from the country’s own problems. They will have to be dealt with. US citizens deserve to be treated according to the law and in line with Washington’s international obligations. In this context, we have every reason to express concern and demand that basic human rights be observed. US officials are constantly and hypocritically taking care of these rights when it comes to other countries; and yet, they have no scruples in ignoring them at home. Why don’t you deal with your own problems? There are plenty of them and they need to be solved.

We intend to continue monitoring this issue and have a serious talk with Washington.

I’d just add we have darn good reason to doubt the validity of the election when 3 months after the election TIME magazine (I don’t take it, my puppy is house trained) publishes an article bragging about how they stole influenced “fortified” the election. Reminds me of a comment a Rabbi made sometime last week on a radio show about how evil has to brag about what it’s done. So meaningless show elections. Characteristic of communism and totalitarian?

Yes, I quoted the whole item in case it “disappears”. How sad is it when Russia has to point out the injustice. And they are correct. There are absolutely stories out there of people that were just at the capitol that day, but were identified (read ratted out) and have had visits from the FIB, full of threats and intimidation. One pair of brave FIB agents even took on a pregnant young mother at home with her four children under the age of 7.

It’s about the ideology, that tops everything. The media celebrates transgender Rachel Levine, the nominee for assistant health secretary who took her mother out of a nursing home two weeks before she started stuffing Wuhan flu patients into them. Meanwhile there is another transgender woman who has been in jail, stripped naked and left in open display with the lights on in her cell for 24 hours a day for 4 days. As of 22nd February, she was still being held without bond. Her crime? Right wing thought. She is a member of Oath keepers and was at the capitol on January 6th. Did she break anything? No. Did she attack anyone? No.

Why would they congratulate Fauci? Could it be that they’re grateful for the massive in-kind campaign donation by his advocacy of a massive lockdown of the American economy in a presidential election year?

I was talking to a friend of mine the other night. He’s an ex-pat living in Nicaragua and has for the last 20 or so years. He said tens of thousands of Nicaraguans have left and are in the US, now. He says they are met at the border with buses, loaded up and taken into America. I said America is becoming a communist country, why would they leave to come here? His answer? Because there they are going to get free stuff. He said one of these days when the government finally lets people out of their houses, there are going to be all these people and we are going to wonder where they came from. Neither one of us felt the need to mention who would be paying for the “free stuff”. Cloward-Piven, here we come. Wonder why congress wouldn’t work on the merit based immigration system President Trump was pushing for? Don’t even get me started on the “covid relief” bill. Children today will be living in economic slavery all their lives. Only about 09% has anything to do with covid relief. Citizens enslaved? Yepper.

If you haven’t listened to the podcast, one of the things the Rabbi points out is to take over a populace you have to keep them beat down and miserable. I’d say the items listed above are steps in that direction.

And last but not least, a Bill Clintoon advisor is concerned. How bad is it when a Clintoon advisor is concerned about what she sees? Former advisor to Bill Clinton and author, Naomi Wolf, was on Tucker Carlson’s Show on FOX News on Monday night. Naomi warned that under Biden America was becoming a ‘totalitarian state before our eyes’.

I’ve been writing for months and months about what I see as the terrible crisis that we’re in, that we have to recognize under the guise of a real medical pandemic. We’re really moving into a coup situation, a police state situation and that’s not a partison thing, that’s, as you say, that transcends everything you and I might agree or disagree on that should bring together left and right to protect or Constitution. We’re absolutely moving into what I call step 10.

I wrote a book in which I pointed out there were 10 steps that would-be tyrants always take when they want to close down a democracy. Whether they’re on the left or the right they always do the same 10 things and now we’re at something I never thought I’d see in my lifetime. You described it really, really well. It is step 10 and that’s the suspension of the rule of law, that’s when you start to be a police state and we’re here, there’s no way around it.

Upside down, honest American citizens are being used and abused, the attempts by the communists to use the power of the government against it’s own citizens is on full display.

But just like Hamen in the Purim story who had the power of the government on his side, he still ended up hanging from a tree. And as the Rabbi pointed out in the podcast, every totalitarian government will try to disarm the populace. It’s been that way since back in Biblical times. Do we have a tyrant in office with such aspirations?

But also like in the Purim story, even though G-d himself is never mentioned and remained hidden, he was there. He responded to Esther and Mordachai’s fast and their prayers. I know many in this country have been praying for G-d to intercede. I do not believe the majority of America wanted to turn their backs on the best economy in many years, the lowest rate of unemployment for minorities for years, if not ever. A man who absolutely embraced citizens being allowed to practice their faith openly, as long as it didn’t involve driving vehicles into crowds of people or blowing up buildings or people. Well, you get the idea. I do not believe the majority of Americans decided they wanted G-d out of America and their lives.

But there is one G-d, only one, and like it says in the Purim parody song, we know who really runs the show. אין עוד מלבדו

Hanukkah 2020

Because I can never see this enough.

We’ve had several columns written about Hanukkah, possibly because I love the holiday. People of faith in both America and Israel have had threats to their ability to worship freely in both countries for as long as I’ve been doing columns.

While both Purim and Hanukkah celebrate the survival of the Jews against an enemy, there are differences. Purim, like the holocaust was an attempt to wipe the Jewish people from the face of the earth. The goal of the Syrians-Greeks was to make the Jewish people like everyone else on the face of the earth, meaning idol worshipers.

This year as we approach Hanukkah, I see my country in a place I could never have imagined growing up. I wonder if it was like that was for the Maccabees? Did they see the threat of the Greeks growing? Because initially when the Greeks gained control over Israel they were respectful. But as some of the Jews began to assimilate, the Greeks lost respect and began to treat them more cruelly. One might say, the mask came off.

Dominion had some help though, for example Mark Zuckerberg of Fakebook. We talk about how he censors posts and information, but he did a lot more than that. About 350 million more than that.

What these grants did was build structural bias into the 2020 election where structural bias matters most – in densely populated urban cores. It converted election offices in key jurisdictions with deep reservoirs of Biden votes into Formula One turnout machines. The hundreds of millions of dollars built systems, hired employees from activist groups, bought equipment and radio advertisements. It did everything that street activists could ever dream up to turn out Biden votes if only they had unlimited funding.

In 2020, they had unlimited funding because billionaires made cash payments to 501(c)(3) charities that in turn made cash payments to government election offices.

Massive numbers of people have come forward to testify under oath about things they’ve seen, or like some nursing home residents, things that have happened to them. Things people were told to do, things that have been recorded on video. Everyday citizens stepping up because they know what they are seeing is wrong, and evil. And those who should care, judges, secretaries of state, attorney generals at federal and state, multiple state actually, levels just don’t care. I’m very disappointed that SCOTUS wouldn’t hear the case Texas and other states brought against those corrupt states. It seems to me if the whole country is about to suffer under the tyranny of the harris/biden regime we should be heard. Some of these states that foolish choose not to be involved are going to be in for a big shock. Because once the socialist/communist party seizes control their autonomy is over. Has anyone ever seen much autonomy in a communist country? Thought not.

Remember the doofus known as Eric Swalwell who threatened to nuke American citizens  who refused to be disarmed and then just claimed he was joking? I’m sure most people realized it’s not normal for elected officials to threaten citizens with nuclear weapons. Well, not communists, no, they wouldn’t see a problem with that. But normal people. So lately it’s become much more clear as to why that would even cross his mind. He was in bed with the communists, no wonder he thinks like them. Yes, literally in bed with them. A Chinese spy named Christine Feng who also implanted a few people into other political positions. Republicans have a problem with Rep. Swalwell being on the intelligence committee and sleeping around with Chinese communist spies.

How much voter fraud, illegal voting, ballot manufacturing etc has taken place? Who knows for sure, the FBI is out investigating garages and subways sandwich shops. But I would hazard a guess that if this level of corruption and a power grab of this magnitude is allowed to succeed, we’re pretty much all done but the shouting. There will never be a real election again, it worked. If it works once that’s all it needs to work because then the communist government has taken control. Things that are moral and honest have been shoved aside. And evil people have been allowed to break the law, lie, cheat, steal and bully and intimidate with no repercussions. Why wouldn’t they do it again?

The democrat/communist party knows the majority of Americans voted for President Trump, thereby rejecting their radical platform. It took a massive amount of vote fraud to overcome those votes cast by real Americans. And yet, the communist/democratic party is now willing to attempt to force their will on those citizens. Those who voted for biden because he was a “moderate” are going to be very shocked when they discover their trial subscription to living in a communist country compliments of Wuhan Flu controls becomes a permanent feature.

I heard a very interesting interview with Rabbi Yitzchok Dovid Smith from www.SaveOurFreedoms.org Rabbi Smith is also a lawyer, has studied molecular biology, virology and infectious diseases at the University of California at Berkeley. He maintains what is being done to the fearful American citizens is psychological warfare and he has some pretty good reasons for saying that.

And at a time of great challenge, the aspiring tyrants in power in NY and CA have forbidden people to attend worship services. And all over the US older Americans have been deprived of getting to see loved ones in their waning years, families are kept apart by fears of a virus with a greater than 99% recovery rate. NO ONE IS SAYING IT’S NOT REAL. We know, it’s real. And it’s also really being used to control people. So things that are normally a large source of strength and comfort to people, things that have helped hold the fabric of our society together in troubled times are the very things those aspiring to rule over us are denying us. Illegally I might add.

I have as much faith in vote tallies as I do Wuhan flu statistics. Sad, isn’t it?

As in the times of the Maccabees of Hanukkah, cruel tyrants tried to forbid people from from the free worship of G-d. They have that in common with communism. Nothing is allowed to be more powerful or revered than the government. People of faith live by G-d’s laws, and love and revere G-d, not big government.

They reclaimed the Temple, they were able to replace the desecrated and stolen items and finally to find the one small cruse of oil. The oil that was only suppose to last for one day, but instead burned for eight. But that’s not the only miracle with the oil. The miracle is that they used the oil and lit the Menorah. The part that I’m apply starts about 5 minutes in. I promise, from minute 5 to the end is good medicine.

That’s the thing about Hanukkah, the Maccabees and the Jews that were remaining faithful to G-d were outnumbered, out gunned and didn’t even have NewsMax on their side. But they did have something better, they had G-d, who loved them. Yes, I think we could be facing an escalation in this fight we’ve been engaged in now for some time. But G-d is not a man who changes, he is the same and the things he wants from us and for us are the same.

I don’t know how this will turn out. I know we can’t rely on people or institutions to save us, almost every institution and so many politicians that campaigned that they would represent us have failed us. The corruption is in so many places, some not even known yet.  No matter what, we can continue to seek G-d, and ask for his blessings on us, our families, homes, country and our way of life. We can try to be prepared and filled with resolve. And we can remember this is the season of miracles. As Rabbi Zev says, “Think good and it will be good”.  I believe in miracles.

Open Carry: Are you normalizing, or making yourself a target?

Rep. Dan Crenshaw, who loves him some prior restraint of rights when it comes to “law & order,” does have some good advice. Stopped clock, twice a day, and all that.

Rep. Crenshaw cut to the chase about how the Second Amendment movement can continue the momentum and the importance for the industry and existing gun owners to change the way they recruit and welcome new firearm owners into the community.

“We need a lot less guys dressing up in their Call of Duty outfits, marching through the streets and we need a lot more women who are talking about how they need the right to defend themselves against a larger man.”

Tom Knighton elaborated in his own words.

“They don’t see those folks as ordinary people. They seem them as a violent militia that might start shooting at any given moment. They’re terrified of what that means.”

The Gun Feed referred to that as “pro-gun LARPing.” I agree; and I’ve addressed it before. Optics — viewpoint type, not firearm — matter. The people we want to persuade need to be persuaded precisely because they don’t view these things as do we.

If you want to sway these people to the Constitutionally correct view of the Second Amendment, do it right.

Tactical gear, ARs and AKs, and scary militant slogans aren’t going to suddenly persuade the Democrat delegates, Democrat senators, and Democrat governor that, “Well, gosh. We were wrong; these are just peaceable, reasonable, nonviolent people who make an excellent point.” Militant appearance and behavior at a lobbying event reinforces their belief that mere citizens are too dangerous to be trusted with arms.

If I’d been planning this, I’d have set up the rally as a silent protest outside, with everyone dressed as neatly as possible in their everyday work attire, to drive home the real point that we are just ordinary citizens, not nutjobs.

That’s one reason to avoid the tacticool look. But consider another. Police and federal agents are also watching.

Do you remember Duncan Socrates Lemp, killed in his bed by police? They targeted him because, due to his display of weaponry and gear, they decided he was an evil boogaloo/militia type. Lemp died for his optics. He won’t be supporting 2A rights much anymore.

Then there’s the “Hey, let’s form a militia, kidnap Gov. Witless, and put her on trial” morons. Sure, the feds had them heavily infiltrated with CIs and agents, and most likely talked them into the ridiculous “conspiracy,” but why target them?

Yep, militia, running around in public with ARs, and the like. They had the right-for-the-feds-purposes look.

They won’t be very active in the 2A community for a while, what with being in jail, awaiting expensive trials.

You absolutely have the right to rig up, and demonstrate with a rifle over your shoulder. But is it worth arrest or death? Does it “normalize” firearms ownership to do something that I’m quite willing to bet isn’t particularly normal even for the tacticool demonstrators? How many of them really dress and carry like that to doctor appointments, or grocery shopping? Outside of training sessions, do they rig up for anything but protests?

There are times and places for the the tactical look, if you want to drop the occasional hint to would-be tyrants. Consider getting a group of fellow veterans together to march in a Veterans Day parade, for example. In completely appropriate setting, you’re saying, “Our regular service may be done, but we’re still willing and equipped to respond as needed.” I’m sure you can think of other appropriate settings.

Otherwise, the setting is probably inappropriate for that sort of thing. If you want to normalize gun ownership through open carry, do it normally. Dress in your normal every day attire, possibly with a little extra attention to neatness. And open carry the pistol you normally carry. Do normal things while open carrying, like checking mail, or mowing the grass (yes, I do).

That’s a lot more likely to convince neighbors you’re a normal person who just happens to own a gun and “Huh, that must be common after all, and no big deal.”

That’s a lot less likely to convince the authorities that you’re another dangerous Lemp who needs to be eliminated, or low-hanging fruit ripe for harvest in a militia terrorism sting. Think of it as “OPSEC.”
