Is the Right to Keep and Bear Arms Dependent On Militia Membership? Part 1

My opposition to Red-Flag laws has been steadfast countenancing no exceptions. Until now. Liberal Time Magazine’s Girl, er um “Person”1 of the Year’s trembling quivering rage-filled Greta Thunberg, who should be starring in H. P. Lovecraft inspired movies, could be that one exception. Ghostwriters and Handlers, please, do not allow Greta near sharp objects or anything that goes bang. Perhaps parents should be scheduling counseling sessions rather than enabling Greta’s delusions of imminent human extinction. Scandinavia once gave the world Vikings. What happened?2

From the Great Depression, mass starvation, to man-created global warming, the Left needs crises with which to menace people. Only through scare tactics terrifying the masses can they evoke reaction based on emotion rather than reason. People who have lost their minds seldom make good decisions. Since the Second World War, the Left, either through ideological compatibility or supreme naïveté, has promoted notions the way to deal with adversarial nations (Communist dictatorships) and people is through non-violent appeasement. Leftists are moral relativists rejecting concepts of good and evil. Therefore global and personal conflicts result from misunderstandings not malevolent intentions. Because people have “issues”, not problems, conflicts can be resolved without anyone having to accept blame or facing consequences. All Stalin needed was a couch, a good listener, and a hug. Today, if the puny underweight wretched victim of bullying stands up to his tormentors, school administrators suspend him along with the thugs. Through its evangelists teaching in public schools, the Left has indoctrinated Americans to reject notions of self-reliance and taking responsibility for their own safety. Lockdowns, shelter-in-place, hide under your desk or in your home…Hence, they grow up to despise the Second Amendment. They are aghast at the idea citizens can own guns and decide when and where to use them in self-defense. Appearing on Fox’s Martha MacCallum Show in response to the Fort Worth Texas church shooting, Democrat strategist Doug Schoen argued people are not competent to carry guns for personal defense. This he added, should be left to the police who, coincidentally, were not there.3 The Left hates the Second Amendment for two reasons; first, it exposes their unwillingness to stand up to bullies and criminals whether on American streets or as heads of State. Think, Justin Trudeau. Second, it is an obstacle to the Great Project.

Whether taking the name Liberal, Socialist, Progressive, Central Planner, Democratic-Socialist, and so forth, Statists are determined to dismantle the Second Amendment either through abolition or redefining it out of existence. Until accomplished, it remains the single greatest impediment to The Project begun by 19th century American Progressives and European Socialists. Its central imperative is to bend the will of the individual completely to the volition of the State to plan, control, and regulate every aspect of human existence. And, the Left is the State. Because altering the Constitution has proven un-doable, the Left has chosen to redefine the Second Amendment as they did the Commerce, General Welfare, Necessary and Proper, and Supremacy clauses until they mean the opposite of their intent. For example they claim owning firearms is dependent upon membership in a federal (Army, Air Force, Navy, Marines) or State (“National” sic Guard) standing army. This claim could not be more wrong.4

Proponents and enemies of the Bill of Rights have debated the Founders’ meaning of “militia” ad nauseam. Rehashing it here would seem superfluous. That is, if its enemies were not using mass media, popular culture, and public dis-education to peddle lies conjoined with an American public too intellectually lazy to read and think for itself. As a recovering public school teacher, I can attest to the pervasiveness of this mental lassitude.

Mises Institute’s Ryan McMaken writes that the Founders’ idea of a militia was not one comprised of “unorganized amateurs”, called up by local authorities, to address insurrection or invasion. Instead, it was to consist of men between a certain age range, proficient in arms, possessing some degree of training in military discipline and tactics, a system of choosing officers, subject to call up by State or local authorities, and under civilian control.5 McMaken’s conclusion is problematic. In the 1740s, the French, perennially at war with England, established a large fort at Louisbourg near Cape Breton, Nova Scotia. From there the French threatened New England with invasion and provided safe haven for pirates and “cruisers” who raided its fishing villages and naval commerce. Finding the British unwilling to act, in 1744 New England raised an army of unorganized amateurs including commoners, farmers, merchants, fishermen, and so forth. With little or no experience, these New England boys executed a successful amphibious landing under difficult conditions, besieged the fort for three months, and forced the French to surrender.6 During the French and Indian War, the British could not have defeated the French without the assistance of colonial militia troops, amateur soldiers who fought as local units under American command.7

On 1 October 1768, in a lead up to what became the War of Independence, Britain dispatched 700 troops led by General Thomas Gage from Halifax, Nova Scotia to Boston. His orders were to suppress resistance to British commerce, trading, and tax laws.8 A month later (8 November 1768), King George III declared Bostonians to be in rebellion against English law and government. British political and military leaders drew up plans to subdue the insurrection.9 They employed their standard method of subjugation; round up, jail, and execute the rebellion’s leaders and door-to-door searches for arms and munitions in private hands. Colonials often stored gunpowder in storehouses outside of town due to its volatility. In order to prevent the Red Coats from seizing it, locals formed militias to guard them. In Virginia, Patrick Henry led the Hanover Independent Militia Company comprised of armed locals independent of the Governor’s control. They comprised the nucleus of resistance against British forces. Other colonies replicated this strategy.10

In 1774, British soldiers marched from Boston into the countryside to seize colonial supplies of gunpowder and weapons in Charlestown, Cambridge, Medford, and Salem. Forty thousand militiamen met the British, called “Bloody Lobsterbacks”, by locals, at Charlestown. These amateurs drove them back to Boston without firing a shot.11 British confiscation of private arms led to the “shot heard round the world”, the British march on Concord and Lexington, Massachusetts, to seize arms.12 Among the militiamen awaiting the British attack were farmers, craftsmen, mechanics, gentlemen, laborers, slaves, dairy farmers, and veterans of the French Indian War. Americans gave as good as they got forcing the British back to Boston.13

McMaken contends, “Gun Rights advocates fixate” on the latter part of the Second Amendment, “The people having a right to keep and bear arms shall not be infringed” as the rationale for private ownership of arms separate from militia membership. He asserts the Second Amendment’s purpose was to guarantee that States “would be free to raise and train their own militias as a defense against federal power and as a means of keeping defensive military force available to Americans while remaining outside the direct control of the federal government”.14 He is correct state militias are supposed to be outside federal control but his assertion the militia is the primary focus of the Second Amendment is incorrect. The Second Amendment clearly contains two independent parts that framers could have fashioned into separate amendments. In fairness to McMaken, his purpose was to demonstrate State Militias are to be independent of federal control and that the so-called “National” (sic) Guard is a standing army and a gross violation of the Constitution.

Drafters wrote definitions of a militia into State Declarations of Rights and later into the federal and State Constitutions from 1791 on. They typically refer to “the mass of ordinary citizens, trained to arms” who would be available for call-up by State or local authorities, and to which was often appended an age range for those subject to service. Founding Fathers from Patrick Henry, George Mason, John Adams to Thomas Jefferson made clear the purpose of the Second Amendment was “that every man” be armed.15 Was this not so that the people would be equipped for militia service if needed? True but only in part. The Founders clearly saw that as an auxiliary advantage. However, the stress was that all men possess the right to keep and bear arms and government in no way have the power to infringe on this right or disarm the people. During debates over ratification of the proposed Constitution (1788) at the Virginia Convention, Patrick Henry declared, “The great object is that every man be armed…Everyone who is able may have a gun”. Zachariah Johnson added, “The new Constitution could never result in religious or other oppression because ‘the people are not to be disarmed of their weapons”. Not militias, people. At the Massachusetts’ ratifying convention, Samuel Adams stated, “That the said Constitution be never construed to authorize Congress to infringe the just liberty of the press, or the rights of conscience, or to prevent the people of the United States, who are peaceable citizens, from keeping their own arms”.16 Again, these rights, freedom of speech, religion, and arms belong to individuals, not states or any other form of organized political entity including militias.

Many States, including Arkansas, Colorado, Missouri, and others specifically state people have an individual right to keep and bear arms and it is not tied to membership in a militia, military, or any form of security force.17 The Founders knew Americans opposed standing peacetime armies (as we have today) and that States were reluctant to cede any of their sovereignty to this new untried federal system of government. They also knew government, like an irresistible force of nature, attracts to it men of ambition, those craving power, and men with no moral scruples. Therefore, they added the militia phrase. States would retain the means to resist federal usurpations of their power and infringement against the liberties of people. Under the proposed Constitution, the federal government, facing a national emergency such as invasion or insurrection, could request the states call up their militias. Governors would send them to federal authorities who in turn would arm, equip, and organize them into a standing army. The States would retain the right to choose officers commanding their militia units. Once the crisis was resolved, militiamen would return to their respective states and mustered out of service. Constitution or not, efforts to “federalize” (actually, “nationalize”) State militias placing them under presidential control began almost at once just as so-called Anti-Federalists had warned.18 The individual right to possess arms was always a separate issue.

English philosopher John Locke’s Treatises On Government were widely read (1689) in the colonies. He argued man had a “natural” (G-D given) right to life, liberty, and property. Inherent in each is the right to the means of defending it.19 Under the supervision of Benjamin Franklin, John Adams, Robert Livingston, and Roger Sherman, Thomas Jefferson wrote the Declaration of Independence.20 Drawing on many widely held philosophical and theological roots; Jefferson wrote that all rights are individual and a gift from G-D. Among them are the right to life, liberty, and the pursuit of happiness (property, wages, and the fruits of one’s labor). Rights imputed by Divinity are inherent in the nature of each individual’s humanity. People are born already possessing these rights. A right to life presupposes a right to the means of defending it.21

The Second Amendment employs the words “right” and “shall not be infringed demonstrating it refers to “a right that is already assumed to exist” (which comports with the Declaration). It does not say, “The people shall have a right to keep and bear arms.” The amendment recognizes but does not grant the right” [emphasis in the original].22 Requirements to join the military, a militia, or engage in a government specified activity in order exercise a right would negate that right. Any regulation, red tape, or hoops one must jump through before accessing a right is a gross infringement and, again, negates it as a right. Governments can in no way qualify a right. No vote by a majority of one’s neighbors to limit a right in any way is legitimate. In addition, people cannot through constitutions or laws, “agree to an infringement on their rights”.23 This is because of the inherency of rights. Only Divinity can alter or abolish rights divinely created. So why does the Second Amendment continue to confound people?

George Mason’s proposed draft of the amendment read, “That the people have a right to keep and bear arms; that a well regulated militia, composed of the body of the people trained to arms, is the proper, natural, and safe defense of a free state”.24 Madison’s version read, “The right of the people to keep and bear arms shall not be infringed; a well armed and well-regulated militia being the best security to a free country: but no person religiously scrupulous of bearing arms shall be compelled to render military service in person”.25 Madison, like Mason and other Founders, wanted it understood that the right to keep and bear arms is an individual right separate from membership in any form of militia. For example, those objecting to military service on religious grounds, still possessed the right to keep and bear arms. This would not be true had the right been dependent on being in a militia. Madison’s intent “is clear not only from his wording, but also from his notes for his speech proposing the amendment”. He states it pertains to an individual right which his “colleagues clearly understood the proposal to be protective of individual rights”. Massachusetts delegate Fisher Ames wrote that among other rights, that of bearing arms “to be inherent in the people”. Writing under the name “A Pennsylvanian” in the Philadelphia Federal Gazette, Madison’s friend Tench Coxe argued that the delegates wrote the Second Amendment to “guarantee the right of the people to have ‘their private arms’ to prevent tyranny and to overpower an abusive standing army or select militia”. Madison read Coxe’s articles and agreed, the amendment pertained to an individual right.26

So much, did the Founders write about the Second Amendment; its meaning is beyond question. These documents and writings are available to anyone. On what basis can opponents of an individual right interpretation justify their position? Simple. The truth is unimportant. Only the Great Project matters. All narratives, including history, must be made to fit and support it. Like a starfish turning a clamshell over searching for a vulnerability by which to penetrate its defenses, so too do enemies of the Bill of Rights search for weaknesses. They find it in contemporary American’s unfamiliarity with grammatical construction.

It is important to keep in mind, of the Bill of Rights none refers to “States having rights”. Each refers to a right of the people. These are individual rights. To argue the Second Amendment applies only to members of a military organization turns it into a State not individual right. We have clearly seen that was not the Founder’s intention. If the Founders had intended military or militia membership dependency in order to own or possess arms, “Why would they say, ‘the right of the people to keep and bear arms shall not be infringed”? Madison and those who shaped the amendment’s wording “chose to put the militia reference into a dependent phrase” choosing “the weakest possible construction by using the participle (word formed from a verb) ‘being’ instead of writing say, ‘Since a well regulated militia is necessary…” The militia wording’s weak form demonstrates its framers listed it as a right of states. “The main independent clause” of the amendment reads, “The people’s right to have guns ‘shall not be infringed”.27

An independent clause is a stand-alone sentence dependent on nothing. The militia part of the Second Amendment forms a dependent phrase. It cannot stand alone by itself containing a subject, verb, and complete thought. Therefore, it is secondary in importance to the main independent clause. The words; “A well-regulated militia being necessary to the security of a free state” would mean what by itself? The words; “The right of the people to keep and bear arms shall not be infringed” would mean what without the first part of the amendment? People have a right to keep and bear arms. By reversing this order, the amendment’s drafters made emphatic that the independent clause was its most important part. “The Founders correctly intuited that in a bill of rights (list), the last thing the reader should have ringing in his mind’s ear is the absolute prohibition on infringement of the natural right to own guns”.28

If the Bill of Right’s enemies read America’s founding documents and writings, they know the truth. None of that matters. What does matter to them is total disarmament of American citizens. The Great Project cannot culminate until that happens. Toward that goal, the end always justifies the means.

The 2019 Maccabees?

Yes, it’s Hanukkah! One of my favorite times of year. We began lighting candles on the 22nd of December, the 24th of Kislev. A facebook friend thoughtfully sent me a picture of a very interesting Hanukkiah, an unusual one to be sure.

Since we are in Hanukkah I’ve been thinking about a lot of things as my candles burn. One of them of course is the Maccabees, what was it like to live at that time, in those days?

I recently received a email from Judah Maccabee. I know! But he seems to be good friends with my Rabbi who must have let him use his computer. This is just the first part of the email he sent.

I time-traveled over 2,000 years to talk to you.

My name is Judah. I’m pretty famous in the Chanukah story.

I’m writing to you today because I need your help.

My brothers and I fought a war to take back our temple and the freedom to be Jewish.

People like to think of us as warriors. Born Fighters. Commanding a small but well-trained army.

Nonsense.

We’re just like you.

Regular people, going about our day.

The pressure grew and grew. And finally, instead of saying “You know what they should do…?” for the millionth time, we just did it ourselves.

It wasn’t easy to inspire people to help. Most of them wanted to keep their regular routine and hope that someone else would step up.

Thank G-d, enough people stepped up, and the story of Chanukah happened.

If you are unfamiliar with the story of how Hanukkah began, the first battle, here you go. But the part about Mattityahu is the part I’m getting at. When the Syrians came to their village in Modiin and built an alter and demanded that Mattiyahu sacrifice on it, to the Greek gods. He refused. A Hellenistic Jew stepped forward to do the sacrifice in Mattiyahu’s name. Mattiyahu killed him, then he and his sons went after the Syrian officers and the rest and routed them.

See, the battle of Hanukkah wasn’t about killing Jews, like The National Socialist German Workers’ Party was. It was about killing Judaism. If you were willing to forgo the practice of Judaism, like the Hellenized reformed Jews were, then everything was hunky dorey. If you weren’t? Not so much. Like Communism, they forbade the practice of Judaism.

So back to Mattiyahu, he recognized the threat of what the Syrians were demanding. Then he took the appropriate actions. He knew who his enemy was.

Do we know today? Do we recognize who our enemies are? Who sees us as enemies?

I don’t know if these two stories have gotten much in the way of #MSM #FakeNews attention. I don’t believe they have.

One is the 70 year old Jewish doctor Sarah Halemi who was thrown off a balcony from three stories up by a muslim yelling about allah’s snackbar. Seems he was angry after a fight, with his own family and the result was a 70 year old woman in the same building dying. The Franceistan courts have taken the matter very seriously. They declared the man cannot stand trial as he was high at the time. Jewish blood is cheap to the French courts.

In America we have another member of the religion of pieces that tried to blow up a plane with 150 souls on board. Bucket O’Chum was a Iraqi mechanic working for American Airline. Really American? You couldn’t find Americans to do the job? Bucket O’Chum attempted to sabotage the guidance system on the plane to bring it down. He faces up to three years in jail. Up. To. Three. Years. 150 people. He may serve as much as one week for each attempted murder. That much? I wonder how many other jihadis work for American Airlines?

It seems to charge either one of these murderers appropriately would be islamaphobic. Really?

The right people in positions don’t see a problem with letting them into these positions, apartment buildings, jobs and the like.

Ah.

So who does some in government regard as enemies? Well, when it comes to the aspiring tyrant, VA Governor Ralph Northam-Demoncrat, it would be gun owners. Because every life is to be respected. Northam on Abortion Bill: Infant Could Be Delivered and Then ‘Physicians and the Mother’ Could Decide If It Lives

Right.

And he just wants a few things from Virginia citizens (right now). Just a few common sense infringements (for now).

The new measures will include “universal background checks, banning the sale of assault weapons and high-capacity magazines, restoring the law that limits purchases to one gun a month, and a red flag law that would empower a court to temporarily remove a gun from a person deemed to be a risk to himself or others.”

Because hey, he’s about safety (for now). He even offered to let people keep their “assault weapons” if they registered them with the state. Because registration has never lead to confiscation.

In addition to letting people keep their legally purchase rifles, he is willing to let gun rights groups continue to have their meetings too!

Which kind of tells you Northam, a Demoncrat, really does consider people control acceptable. When he was asked about the growing number of Second Amendment Sanctuary cities he said he wouldn’t retaliate, that’s not what he’s about. He then changed the word and said there would be “consequences”. Ah, all better then.

A fellow Demoncrat in the US House of Representatives, Donald McEachin, then suggested using the National Guard against American citizens. So of course the National Guard started getting calls. Not a lot of comfort there.

“We understand and respect the passion people feel for the U.S. Constitution and 2nd Amendment rights. We will not speculate about the possible use of the Virginia National Guard,” he added.

But Demoncrats from VA have lots of ideas on how they can control people.

Here’s the deal: a Virginia Democrat, Jennifer Wexton, has proposed a bill which would use your credit card purchases to track your gun purchases, and history shows that this data will be used against you.

The battle of Hanukkah was about people living as free people in their land, worshiping G-d as he had instructed them. And to some that was just unacceptable. The Maccabees weren’t the modern forerunner of the IDF, they were regular people who stood up. Just like those in Virginia who are fighting back against attempts by Hellenizing Demoncrats to force them to live in subjugation to whoever decides they will “rule” and not “serve” as an elected official.

Hands down, best Hanukkiah ever!

Because I can never see this enough.

Malicious Compliance Revisited

With registration schemes in the works, let’s imagine a humorous, purely hypothetical scenario.

Police State A passes a registration law.

Folks in other states publicly post something along the lines of, “I happen to know that someone in [NOT-State-A] has an AR, [manufacturer] [model] serial number 12345xxx. Plenty of credible examples.

“Compliant” A-Staters use that data to cram the State A’s database full of realistic-looking garbage: variations on out-of-state weapons. Change the serial numbers.

And never forget the overly compliant. Register a few hundred per person. You’ll probably make typos on the forms, so be sure to requisition plenty. And early, as they’ll likely run out.

Now that places such as New York City and California are doing their best to generate new Dim-ocrat voters-to-be with sanctuary and ID for “undocumented” illegals, those identities could be the ones “registering” their imaginary “assault weapons” and half-million-apiece magazines. I’ve heard that in Chicago, 1060 West Addison Street is a traditional address.

With millions of bogus database entries, I expect it’ll be a while before they sort through them and find “real” people who… “Darned boating accidents.” Mischievous types will want to get their lost/stolen reports in ahead of the expected rush. If they go low-bidder on the software, our little Simon Jesters might even crash the database.

If nothing else, this should lower unemployment, as governments recruit more clerks to handle the data entry.

Compliance; New Zealand Style

I’m sure you heard that the New Zealand gun grab has begun.

Dozens of Christchurch gun owners on Saturday handed over their weapons in exchange for money, in the first of more than 250 planned buyback events around New Zealand after the government outlawed many types of semi-automatics.

Interesting. To read the headline, you might think New Zealanders were eagerly swapping their guns for cash. Lessee…

This article guesstimates the number of firearms at 1-1.5 million. I’ll roll with that even though 1.5 million is the low end of other estimates I’ve seen.

Let’s say there are a mere one million guns to be turned in. There will be “more than 250” turn-in events; call it 259.

To get all the guns, they need to average 3861 per event. Oddly enough, while this story gives the number of people turning in guns (169), it doesn’t say how many guns were turned in. But they shelled out around NZ$430,000 ($288,000) to those 169.

NZ$2544/US$1705 per head. The payment is based on firearm age, and never goes more than 95% of market value as I understand it. So let’s say that was two guns per sucker.

338. That is: 8.75% of the average 3861 they need to get all of them.

That’s some compliance rate. And that’s the “best case.” “Worst case” is a mere 4.4%, based on another high end estimate I’ve seen.

Hmm. That could be a million torqued off gun owning voters. Given that 2017 election turn-out was 2.6 million, 2020 elections in New Zealand could be as interesting as in the US.

Yom HaShoah 2019

Today is Yom HaShoah and Ghetto Uprising Remembrance Day, the 27th of Nisan.

The first Holocaust Remembrance Day in Israel took place on December 28, 1949, following a decision of the Chief Rabbinate of Israel that an annual memorial should take place on the Tenth of Tevet, a traditional day of mourning and fasting in the Hebrew calendar. The day was marked by the burial in a Jerusalem cemetery of ashes and bones of thousands of Jews brought from the Flossenbürg concentration camp and religious ceremonies held in honor of the victims. A radio program on the Holocaust was broadcast that evening. The following year, in December 1950, the Rabbinate, organizations of former European Jewish communities and the Israel Defense Forces held memorial ceremonies around the country; they mostly involved funerals, in which objects such as desecrated Torah scrolls and the bones and ashes of the dead brought from Europe were interred.

In 1951, the Knesset began deliberations to choose a date for Holocaust Remembrance Day. On April 12, 1951, after also considering as possibilities the Tenth of Tevet, the 14th of Nisan, which is the day before Passover and the day on which the Warsaw Ghetto Uprising (April 19, 1943) had begun, and September 1, the date on which the Second World War had begun, the Knesset passed a resolution establishing the 27 Nisan in the Hebrew calendar, a week after Passover, and eight days before Israel Independence Day as the annual Holocaust and Ghetto Uprising Remembrance Day

As it is not that long past Pesach, Shimshon my puppy and I recently watched the movie The Ten Commandments starring Charlton Heston. For a few reasons I wanted to see this movie again. It really is still an amazing movie. In an age of Star Wars effects, the Ten Commandments special effects still awe me. But in the substance department, well, there is no comparison. What I do not remember ever seeing though was the opening.

And I think that is a question well worth considering in this day and age. Will we be ruled by G-d’s laws or the whims of a dictator? There are many in this divided country that very much want to see a President elected by the people deposed through any means, but all of them foul. They want power, and they planned to rule over us and his election upset their apple cart. Those forces have much help from the media, the useful idiots like #MoneyHogg and they will push their agenda of socialism and communism at all costs.

Farmers and peasants who had worked the land and fed Russia for generations were being forced into state-run collectives, with countless arrested, exiled or executed for resisting or to make an example for others. Productivity inevitably plummeted, bringing about food shortages, but it was not an accident.

“Coercion was the only way to attain wholesale collectivization,” writes historian Stephen Kotkin about Stalin’s position, which he took as a believing Marxist-Leninist. “The extreme violence and dislocation would appall many Communists. But Stalin and his loyalists replied that critics wanted to make an omelet without breaking eggs.”

You can hear #LipstickLenin (Alexandra Occasional-Cortez) or “Feel the Bern” millionaire Sanders saying that way all in the past, it just wasn’t perfected yet. It was in infancy.

Let’s take a look at what a reporter from MSNBC let slip. I have no idea if he still has a job or not.

While covering Venezuelan dictator Nicolás Maduro’s efforts to hold power, MSNBC reporter Kerry Sanders noted Maduro has the advantage of guns against an unarmed populace.

The MSBNC segment, published by The Washington Free Beacon, begins with anchor Andrea Mitchell expressing surprise that Maduro is still holding on.

Sanders responds, “Not only hanging on, but he appears to still control the military. You have to understand in Venezuela, gun ownership is not something that is open to everybody. So if the military have the guns, they have the power.”

Sanders adds, “So as long as Nicolás Maduro controls the military, he controls the country.

The average citizen of Venezuela lost around 19 lbs in 2017 and 24 lbs in 2018 I believe is what I heard.

Food, it’s such a great way to control a populace. Cow farts must be eliminated or the earth will self destruct in 10 or 12 years. Depending on if it’s Lipstick Lenin or Bozo O’Rear. Demonize food, demonize those that produce it, and how they do so, and then regulate them into starvation production.

Ruled by the whims of a dictator the citizens are reduced to attacking by hand and Molotov cocktails if the supplies can be procured. They are attacked and literally run over by the dictators troops and tanks.

Ari Fuld HY”D pointed out in a 2016 radio broadcast that “Never Again” doesn’t mean anything. Because “diplomacy” triumphs over “decency and morality”. How many countries signed peace treaties with hitler? How many dead Jews since Oslo was signed? More than in all the years before it. Not even the US would bomb the train tracks into Auschwitz. People place diplomacy above morality and doing the right thing. But you can hear the whole podcast. Fools who want peace but get war.

In these days of anti-semitic cartoons and condemnation of Israel by left-wingers of all strips, countries and religions I found Moshe Feiglin of Zehut’s Yom HaShoah post very very powerful and moving. Ari pointed out how many Jews tried to reach the safety of Israel in those horrible days before and during the holocaust only to be turned away by the British. They were sent back to be murdered by the nazis. Israel, their home, the home that had lived in their hearts and the desire of their souls to return there always burned through every generation. It’s part of our identity. Here is his post translated into English.

It’s a Good Day For Liberty

Years ago in a galaxy far far away, I served on the board of a couple of Second Amendment groups. One of them very much a grassroots group and it was very active in the legislative process and citizen lobbying. Contrary to what people are sometimes lead to think, “lobbyist” is not a dirty word, or a bad thing. Many people have jobs, employers seem to expect that their employees will be at those jobs. So, when there is legislation that matters to gun owners be it a bill to expand gun rights or a bill proposing further infringement of a law-abiding citizens rights with yet another gun control scam disguised as “gun safety” it would seem fair that the law-abiding citizen should also have their voice heard. Ahh, the conundrum. What is the law-abiding citizen to do? They have a job, but they also have rights that need to be defended. Well, the Second Amendment groups in the state went together and hired a lobbyist to be present at the hearings and speak on behalf of the voters that held opinions most firm about further infringement of their G-d given rights, namely self-defense. From time to time the lobbyist would be accompanied to these hearings by the leadership of the Second Amendment rights groups, and I was privileged to be one of those. A citizen lobbyist, who also happened to represent a passel of voters. I had the high heels and a sparkly barrette. I considered these vital, but not as vital as a couple of other things I possessed. A mission, and resolve. I enjoyed this mission, legislators can be quite tasty if bar-b-qued with BBQ sauce. /snark, remember, I’m a vegetarian.

It’s been a while since I’ve attended a rally day. In my state there has been a Second Amendment day at the Capitol for years. Usually towards the end of the season, and usually there is a major bill or two we are wanting big time bad, or a big time bad bill we want to see die an inglorious death. I started going back before my state had concealed carry, the lobby was packed full that day, it was standing room only. For years I went every year, even spoke at a couple of them. The last few years I haven’t made it, for various and sundry reasons. But I’ve made it the last couple of years, and this year was just grand.

I did the hike from the parking lot to the capitol and entered the door to the meeting area. The police were there with the airport style scanning machine. I was met by a young police officer when I placed my purse on the table. He regarded my purse dubiously.

Sir: “Ma’am, are you lawfully carrying concealed?”

Me: Yup

Sir: “I’m going to need a driver’s license and a concealed carry card”.

Me: You are an officer of the law, you should already have these credentials.

After a second for my brain to catch up with my mouth, I grinned at him and said, I’ve got to get them out of my purse, ok?

Sir: “Yep, I have a concealed carry. My friends ask me why I bother and I tell them because it’s the right thing to do.”

Me: I like you, I like the way you think.

He regards the depths of my purse skeptically after he studys my cards.

Sir: “Do you carry in your purse?”

Me: Nope.

Sir: “Good, I worry that if a purse was stolen you’ve now lost your defensive tools.”

Me: Oh I do like you, nope, no purse carry.

Sir: “Which side are you carrying on?”

I answer him, and he tells me after I set off the machine the officer at the other end will wand me. I go through, set off the machine get wanded and I’m good to go. I thank them both for what they do.

I went in, said hi to a lobbyist I’ve worked with, sat with some dear people that I haven’t seen for awhile and listened to some great speakers. The MC is well known in the Second Amendment arena as the guy that wrote the book on gun laws. Which is fair enough, he did write the book on gun laws.

It was interesting, the speakers were great, acoustics are always challenging in that room, but still it was good. Two floors up there was some sort of school event going on. A bunch of school children, I’m guessing pre-teen, or early teens must have disapproved of us being allowed to speak in public. When one of the speakers would start to speak, they would start yelling trying to drown out the speaker. Think there is much indoctrination going on in the tax payer funded schools? I’m telling you, Zehut has the right idea, school vouchers for everyone.

After rally we all split up to go speak with our legislators about the bills we want passed, and I also wanted to mention my extreme aversion to “Guilty until proven innocent” Red Flag gun confiscation. I had mentioned my aversion to my former lobbyist mentor and he said while of course the misogynistic mad mommies are pushing for it, it hasn’t gained traction. Good to hear. I don’t know why mad mommies hate women so much that they want to deprive them of a tool that even elderly women can use to equalize the situation, but they do.

Our MC ended the rally with his trademark line, “It’s a good day for liberty”. He always opened his monthly column with that line. And it was a good day for liberty, every day is a good day for liberty. But we must fight for it, there are forces that will not be happy until they have all the power they want, and as long as there are armed citizens, they know that won’t happen. They use whatever tactics they think will work, whether it is going after politicians sympathetic to us with blatant lies and accusations that their allies in the mainstream media help them spread or lies about “ghost guns” or citizens that defended themselves. Be it vote fraud or illegal immigrants voting, they will use it.

We must remain strong in our convictions and our determination. Where the room was packed a few years ago when we wanted, demanded, concealed carry it was now not as full. Attendance was good, but it needs to be bigger. I saw one old friend, he and his young son were there. This man and his wife want their children to learn about freedom and the legislative process and how the two go together. Those kids have been citizen lobbyists since they were probably 4 or 5 years old. Maybe even younger. The legislators sit up and take notice when large groups of people have taken the day off work and showed up to demand their rights be honored. G-d gives rights, legislators recognize or infringe on them.

My lobbying mission finished, I headed for the exit for the drive home. As I walked by the door to the exit I passed the door you enter, Sir and his partner were still there checking people, I smiled and waved at them and said thank you, they both smiled and waved back. It never hurts for the Second Amendment people to be the nice polite friendly ones.

So if you have a chance, and your state has a rally day yearly, go. See friends, network, make friends, talk to your legislative critters. Don’t let bloombergs paid harpies be the only voice being heard at your capitol.

Tonight starts Pesach, Passover. We each leave our own slavery in Egypt behind. I believe it is a constant process, sometimes easier, sometimes harder. But I don’t want to be one of the Jews that chose to stay behind in Egypt rather than face the unknown. I believe that G-d does want freedom for us. This year is a very meaningful Pesach for me, and I hope that you all will have a very blessed holiday as well. Thank you for being with us, The Zelman Partisans as we travel this path together.

Bump Stock Compliance

I did my bit.

If you can’t read that (the rubber bands interfered with scanner focus):

To whom it may concern,

Please find enclosed 1 “baker’s dozen” (representing the 13 colonies which rose up in armed rebellion in response to an attempted confiscation) potential bump-stock-type devices (BSTD).

While I realize that you have argued that rubber bands are not BSTDs, I choose not to take the chance, since rubber bands can provide the same spring effect of an Akins Accelerator-type device, and the ATF has a history of pseudo-random changes of mind (shoelaces coming to mind).

Please be assured that I am not in possession of any device you do consider to be a BSTD “machinegun,” unless you change your mind about belt loops which can operate in the same fashion as a springless BSTD.

Oregon Firearms Federation vs Oregon Ceasefire. Who is antisemitic?

A week or so ago one of our Zelman Partisans facebook readers sent me a copy of a letter from Oregon ceasefire, a victim disarmament group.

Today is Holocaust Remembrance Day, today I shall address the situation.

I had seen an alert from Oregon’s Firearms Federation about the mask being off, but I hadn’t been aware of other very serious things that were going on with this gun rights organization. But after I read the letter from Oregon Ceasefire, my eyes were opened! It seems Oregon Firearms Federation is antisemitic according to Oregon Ceasefire! I am shocked an appalled. Antisemitism is one the rise everywhere, from Jews in Francistan that can no longer wear a Kippah in public safely to the US where two muslim women have been elected to congress. One of whom supports BDS and has made antisemitic tweets about “Israel hypnotizing the world” and the other has covered up the one Jewish state on her map with the name of a country created in 1964, same year as the Beatles by the way. Indeed, this charge of a Second Amendment rights group being antisemitic needed investigation! So, I did.

I wrote both groups, and asked what incident lead to such a charge?

I wrote Oregon Firearms Federation first. Please note, I’m not a reporter, I’m a columnist and so I have no guilt over telling them to keep up the good work.

It’s a few days later now, I’ve heard back from Oregon Firearms Federation(OFF), I have not heard back from Oregon Ceasefire.

It seems according to Oregon Firearms Federation the charge was prompted by a page that OFF had on their web site.

Ah! Indeed the images are horrific. Horrible images of the Holocaust, please G-d may such a thing never happen again. A sane person would never want to see such images mar the pages of history. If you have a pipe freeze and break in your house due to a air leak that can reach a pipe (speaking from experience here) one would do their best to assure that such conditions will not re-occur by sealing the leak. They would not get a hammer and enlarge the hole. But then I’m me, and the hole got sealed. Oregon Ceasefire is not me. They choose to grab that hammer. It’s worth noting that when Oregon Firearms Federation emailed me back, they informed me that the page had been up for months, and apparently in an attempt to get their name back in the news, Oregon Ceasefire notified the media who promptly called the “experts” in their Rolodex that will recite what they want to hear. But please note that the Rabbi in question Michael Z Cahana has 180 degree different opinion on these matters than another Rabbi Kahane, who’s motto was “Every Jew a .22”. Rabbi Meir Kahane HY’’D הי״ד to be exact. So Rabbi Cahana in favor of defenseless victims, most certainly does not speak for us all.

But back to the matter at hand, one of the pieces of legislation, victim disarmament if you want to call it what it is, is SB0501 according to OFF.

Requires person to secure permit before purchasing or otherwise receiving firearm. Specifies qualifications for permit and manner of applying for permit. Creates procedures for appealing denial of permit. Punishes receipt of firearm without valid permit by maximum of 364 days’ imprisonmen $6,250 fine, or both.

Requires person who owns or possesses firearm to secure firearm with trigger or cable lock or in locked container.

Punishes failure to secure firearm by maximum of 30 days’ imprisonment, $1,250 fine, or both.

Requires person who owns or possesses firearm to report to law enforcement agency loss or theft of firearm within 24 hours.

Punishes failure to report loss or theft by maximum of 30 days’ imprisonment, $1,250 fine, or both.

Prohibits possession of magazine with capacity to hold more than five rounds of ammunition.

Provides that person in possession of such magazine must sell or otherwise dispose of magazine within 180 days of effective date of Act. Punishes unlawful possession of magazine capable of holding more than five rounds by maximum of 364 days’ imprisonment, $6,250 fine, or both.

Requires criminal background check before transfer of ammunition. Restricts ammunition receipt to 20 rounds within 30-day period.

Prohibits transfer of firearm by gun dealer or private party until latter of 14 days or Department of State Police has determined that recipient is qualified to receive firearm.

Alrighty, now let’s take a look at some actual nazi (no, they still don’t get capital letters) gun laws.

Straight from the Book “Gun Control” Gateway to Tyranny. Let’s have a look-see, shall we? See if anything looks familiar. Remembering that the Gun Control Act of 1968 was based on nazi weapons control laws of 1938, Sen. Chris Dodd’s -D daddy Sen. Thomas Dodd -D had a copy of the nazi weapons laws that he had translated. It was on those laws that he based his gun control act.

As Aaron points out in the book, these gun control laws are immoral. Because they treat the law abiding citizen in this manner as a reaction to acts committed by criminals. Torah absolutely supports self-defense. Too many blather “Thou shalt not kill”. NO, and more no. It says “Thou shalt not MURDER”. Not the same thing.

So the virtue signaling Oregon Ceasefire chooses to ignore (or never learned) history. Let’s do a brief recap shall we?

How the Nazis Used Gun Control

In 1931, Weimar authorities discovered plans for a Nazi takeover in which Jews would be denied food and persons refusing to surrender their guns within 24 hours would be executed. They were written by Werner Best, a future Gestapo official. In reaction to such threats, the government authorized the registration of all firearms and the confiscation thereof, if required for “public safety.” The interior minister warned that the records must not fall into the hands of any extremist group.

In 1933, the ultimate extremist group, led by Adolf Hitler, seized power and used the records to identify, disarm, and attack political opponents and Jews. Constitutional rights were suspended, and mass searches for and seizures of guns and dissident publications ensued. Police revoked gun licenses of Social Democrats and others who were not “politically reliable.”

During the five years of repression that followed, society was “cleansed” by the National Socialist regime. Undesirables were placed in camps where labor made them “free,” and normal rights of citizenship were taken from Jews. The Gestapo banned independent gun clubs and arrested their leaders. Gestapo counsel Werner Best issued a directive to the police forbidding issuance of firearm permits to Jews.

On October 4, 1938, Nazi police arrested one Alfred Flatow in Berlin. His crime: being a Jew in lawful possession of a firearm. Lawful because he had dutifully registered his guns in January 1932, complying with the pre-Hitler anti-firearm decrees of the Weimar Republic. The arresting police were probably unaware that Flatow won Gold and Silver medals for Germany in the 1896 Olympics. He had also served in the German army in the 1890s.

The Nazis also moved to control others who possessed weapons. Despite protests, the government banned all voluntary “shooting clubs” (Schuetzenvereine) in Germany. These clubs were popular forms of recreation across the nation, and many club leaders opposed the ban and even expressed objections to the Nazi government. As Hitler was rapidly centralizing and broadening his powers, he dissolved all local and independent shooting and sports clubs on May 10, 1933. Two weeks later, he created the Nazi-controlled German Shooting Sport Association (Deutscher Schiesssportverband), which became another mouthpiece for the Nazi government and, with war on the horizon, a source of males already trained in marksmanship.

So many of the laws advocated by Oregon Ceasefire have been implemented. What did that lead to?

I’ll let the witnesses tell you themselves.

I understand that part of the reason Oregon Ceasefire reached out to Der Stürmer, the media was because they are losing relevance since Michael Bloomberg began shoveling money into Mad Mommies, his favorite astro-turf group. So, if all guns are evil and people will be safer if they are all banned he will no doubt be glad when that happy day comes right? Um, no. Seems Bloomberg is a elitist hypocrite.

“When you have a city that has the murder rate that Baltimore has, I think it’s ridiculous to think that they shouldn’t be armed,” Bloomberg said of the Hopkins security force.

A group of Hopkins students called Students Against Private Police expressed dissatisfaction with Bloomberg’s remarks. In a statement, the group said Bloomberg’s support for a private, armed police force is at odds with his other work to promote gun control

Just an FYI: The Bloomberg School of Public Health is located at John Hopkins. There moulders the academic wing of Bloomberg’s Center for Gun Policy and Research, anti-self defense, of course.

I’m actually shocked, I mean Baltimore has a Demoncrat Mayor a very strict gun control as it is. Why on earth is Bloomberg worried about high crime?

So, in conclusion. Is Oregon Firearms Federation antisemitic? No. They oppose laws that enabled the brutality of the Holocaust, and if you’ve forgotten just how brutal it was, or never learned, that page reminds you. A post on my Zehut list mentioned a poll conducted by Schoen Consulting found that 11% of all US adults and 22% of millennials haven’t ever heard of the Holocaust. Perhaps Oregon Ceasefire is one of them.

Is Oregon Ceasefire Antisemitic? I think so. If you can compare what they are advocating with what nazi Germany had for gun laws and the persist in doing so, I would say yes they are. I believe as you look at the rise of antisemitism world wide it’s imperative that Jews learn to shoot and be ready to do so.

To that end I reached out to one of my favorite groups, Cherev Gidon. In the wake of the Pittsburgh Synagogue attack they came on my radar. I asked a simple question, Why do you do what you do? Why are you teaching Jews and others to shoot and how to defend themselves?

Yonatan, director and founder was kind enough to answer me.

Cherev Gidon Israeli Tactical Training Academy exists for the purpose of training American Jews with Israeli combat shooting skills, so that every American Jewish community will be well armed and professionally trained with the ability to mount an effective defense against any violent attack on any Jewish community (as we saw in Pittsburgh). Our goal is to have each and every American Jew carrying a firearm with them to synagogue (and everywhere they go), so that never again will any Jew fall victim to antisemitic violence. Thankfully, our program has become incredibly popular recently, and we are actively achieving our goal of making those communities hard targets. We are currently expanding to different regions and communities across the US as a result of the unprecedented demand and we hope to be able to make our training programs easily accessible to all Jews, no matter what part of the country they live in.

A simple flowchart

Everyone has flowcharts, companies have them, to perform CPR there is a flowchart, to fix a car there is a flowchart, to diagnose illness or even make financial decisions, there’s a flowchart.

So I decided I needed to make us a little flowchart. It’s another one of those things where I see two things that fit together, well, in my mind.

First off we have this story about a 25 year old woman. She was alone at a bus stop minding her own business in essentially gun free, so crime free Chicago. Or, as some call is Chi-raq.

Residents are praising the 25 year-old woman, with a concealed carry license, who shot and killed a man who was trying to rob her at a bus stop.

Surveillance video shows the woman waiting alone at a bus stop at 103rd and Wallace around 5:45 a.m. Tuesday. Police say a 19-year-old man, in a light colored hoodie, pulled a gun on the woman in an attempt to rob her.

She pulled out her own gun and shot him in the neck.

How’s about that! So that made it all the more interesting when I saw this cartoon on facebook the other day. My buddy Chris puts up great stuff. Then I’ve been watching Miss Fisher Murder Mysteries. It’s set in 1920s Australia, before it was a gun free paradise. Back when women could defend themselves. This was the first one I watched called I believe “Cocaine Blues”. Costumes are beautiful, very elegant, the cars are amazing and the music is swell. The stories are great, when watching the first one it hit me! A flowchart. A simple flowchart to determine if you value women’s lives. To be fair, it can be anyone’s life, but all these stories involve women. Apples to apples don’t you know?

So without further ado, my first flowchart.

Happy Hanukkah 2018

Happy Hanukkah! The story that celebrates the victory of the Maccabees, a Jewish Priestly family from Modiin that aren’t Israeli, didn’t live in Israel and they defeated the Greek empire that wanted to force them to abandon their faith, their heritage and their G-d.

If I were going to write the story today I would cast Jewish Voices for Peace, J street, If Not Now, B’Tselem, and leftist Jews as the Hellenistic Jews of the Hanukkah story. Because they work against Israel and those that want to live life according to Torah. It’s kind of interesting to me, I recently took a class called “Wrestling With Faith” in it we talked about the Mitzvot. The 613 little holy bread crumbs G-d gave to leave a path for us to follow to find him. You want to get to know someone? You ask him or her questions about themselves, and sometimes getting that information is like pulling teeth. G-d plays no such games with us. He says these things I like, these things I don’t like. You want to make me smile? You want to show you are a child who listen to their father? These are house rules. Which kind of baffles me when people tell me they don’t matter anymore. Maybe I just haven’t found the Parasha where it says G-d changed him mind about those. But that was the point of the Hellenization. To separate the Jews from the things that G-d ask. It’s like doing everything the opposite of what your boss, significant other, spouse or coach says you should do and then expecting them to still feel the same way about you. It doesn’t usually play out that way. So Hellenization was meant to turn people from the worship of G-d to the worship of the human body, art, and pagan rituals. They wanted to convince the Jews living in Israel that they didn’t need to observe the new months, circumcision, Torah study, Shabbat observance. They wanted to drive a wedge between the people and G-d.

It definitely wasn’t safe to openly practice being a Jew in Israel at that time. As other times down through history different people of different nations have tried to eradicate Jews and their Judaism. It never began with cattle cars, concentration camps and ovens. It began with yellow stars and discrimination. At the end of WWII the world joined us in vowing #NeverAgain, and now there has been a self serving attempt to cheapen that phrase by a money grubbing, attention seeking political pawn who is protected by armed guards even as he oinks out that those that can’t afford paid protection be rendered defenseless. Little swine.

Did we think that would be the final attempt after the final solution? Well, it wasn’t.

Tlaib in the interview also came out in support of the Boycott, Divestment and Sanctions movement against Israel, which she said brings attention to “issues like the racism and the international human rights violations by Israel right now.”

Ilhan Omar of Minnesota, the other Muslim woman elected to Congress in November, said in an interview shortly after the election that she supports the BDS movement after saying during her campaign that it was “counteractive” and prevents dialogue.

One might think it’s becoming unsafe in America for Jews to openly admit or display their faith. One would be correct. From wonderful Jack Engelhard in a column titled Americas Hidden Jews. This whole column is well worth reading.

Professor of Jewish and Holocaust studies at Columbia University Elizabeth Midlarsky is about the only one at the college who dares to identify herself openly as Jewish.

A few days ago she walked into her office to find it vandalized with anti-Semitic graffiti. “They got me,” she told The Washington Post. “I’m afraid.

And then we have Airbnb or AirBS depending on if you ask the company or me what their name is. AirBS is a site where people can list property, apartments or rooms they have to rent to vacationers. They have recently decided parts of Israel aren’t in Israel. So any of the Jewish homes listed in Judea and Samaria, the Biblical heartland, were removed. Not the Falistinian ones mind you, they’re still listed. Just not the Jewish ones. Have they done this in any other part of the world where there is dissension occurring? Why do I bother asking? Of course not. It is flat out anti-semitism. Are they being called out for it. Nope.

Remember in the Hanukkah story how a Hellenized Jew was going to sacrifice a pig on the alter in Modiin since Matthias Maccabee refused to do so? Matthias killed the corrupted Jew, and then the King’s officer that was commanding such a thing. There would be no pigs sacrificed on alters in the Maccabee name. The Hellenized Jews were trying to corrupt the pure ones. They’re still active today.

Daniel Pipes is determined to make it clear to the Arabs in Judea and Samaria that in order to survive they must recognize Israel.

The Maccabeean revolt was a two fold war. One, it was incredible military victories, G-d gave many many miracles over the years the battles were fought. The other was the war of faith, religion or culture. However you choose to look at it.

I think I’m going to have to disagree with Lord Rabbi Jonathan Sacks this time. In his Hanukkah message this year he seems to me at least, to believe the great battle was for education, not military battles. I believe without the military battle of G-d through the Maccabees, there would have been no educational victories. To quote Dinesh D’Souza yesterday, he was discussing the difference between George H.W. Bush and President Trump. He said “sometimes you need Mother Teresa, and sometimes you need Dirty Harry”. I would add and sometimes, no one less than Judah Maccabee will do.
