They have discovered the dangerous precedent of allowing the ATF to redefine words to make inanimate bits of plastic into machineguns, paperweights into firearms, and pistols into rifles. Well, no sh-t, Sherlock. TZP has been warning about this specifically for nearly fours years. We warned about this before the ATF even proposed the bump-fire stock machinegun rule.
We warned you again two years ago, when that very “easily converted” argument was made in court. We warened you repeatedly.
We warned you in 2018 that easily converted to a higher rate of fire would define “machinegun.”
“What’s going on in 2021” maybe wouldn’t have been such a problem if more people had paid attention to what was going on in 2017, 2018, 2019, and 2020. More attention than ridiculing those of us warning about “Bump Stock Hill” anyway.
Speaking only for myself as an individual: There have been many days in recent years when I seriously questioned why I bother with trying to raise awareness of these dangers. This is one of those days. My work seems pretty pointless.

Before going to market, they took the FRT-15 to four separate subject matter experts, who all, independently said the trigger was semiautomatic. Personally, in terms of the language of the law, I think it’s a no-brainer since very point of the trigger is that it forces a reset absolutely requiring the user to pull the trigger once again before it will fire.
(b)Machinegun The term “machinegun” means any weapon which shoots, is designed to shoot, or can be readily restored to shoot, automatically more than one shot, without manual reloading, by a single function of the trigger. The term shall also include the frame or receiver of any such weapon, any part designed and intended solely and exclusively, or combination of parts designed and intended, for use in converting a weapon into a machinegun, and any combination of parts from which a machinegun can be assembled if such parts are in the possession or under the control of a person.
The ATF has adopted a new definition of “function of the trigger” to mean “volitional movement of the finger.” Read that. Do you see “volitional”, “movement,” or “finger” in there anywhere?
And even that is remarkably stupid, even for an agency that thinks inanimate pieces of plastic are machineguns. One more time: The FRT-15 forces a reset and requires the user to consciously and manual pull the trigger again to fire. At least with a bump-fire stock, the finger could passively sit on the ledge, while the user — consciously and manually operates the action with his off-arm.
I assumed that Rare Breed Triggers would file a lawsuit. In the video, Mr. DeMonico confirms that a suit has been filed. Once I knew that, and in which court, it took me approximately 10 seconds to find it; and most of that time was spent typing search terms. The case is Rare Breed Triggers, LLC et al v. Garland et al.

There’s the matter of his subject matter experts. They were… the ATF’s subject matter experts. One literally wrote the ATF’s academy course on machinegun identification. Another taught the course in machinegun identification.
Those people are going to walk into court, present their prior-ATF credentials, and explain that the FRT-15 is semiautomatic.
The ATF is going to walk into court and tell the judge and jury that fingers are triggers.
Please note that only one person had been charged with unlawful possession of a bump-fire stock machinegun. When defense showed up with an expert witness who said bump-fire stocks are not machineguns, the prosecution dropped the charge, rather than try to tell the judge and jury that fingers are triggers.
This case won’t be in a Ninth Circuit court. The judge is probably going to be pounding his gavel and demanding order when everyone cracks up laughing.
Mexico sues US gun manufacturers over arms trafficking toll
The Mexican government sued United States gun manufacturers and distributors Wednesday in U.S. federal court, arguing that their negligent and illegal commercial practices have unleashed tremendous bloodshed in Mexico.
The unusual lawsuit was filed in U.S. federal court in Boston. Among those being sued are some of the biggest names in guns, including: Smith & Wesson Brands, Inc.; Barret Firearms Manufacturing, Inc.; Beretta U.S.A. Corp.; Colt’s Manufacturing Company LLC, and Glock Inc. Another defendant is Interstate Arms, a Boston-area wholesaler that sells guns from all but one of the named manufacturers to dealers around the U.S.
It appears some of those outfits being sued are suppliers for the Mexican army and police. I suggest those manufacturers go all Ronnie Barrett, and stop selling or servicing weapons for Mexico. Barrett itself may be inclined to do so since Mexico uses their .50 BMG platform.
I think Mexico’s time and money would be better spent at home, cracking down on cartels like Los Zetas, which has been armed and equipped — not to mention staffed — by the Mexican army;they are after the smugglers and unlawful users of the weapons. Hey, Mexico could sue their army for trafficking guns to cartels.
The Protection of Lawful Commerce in Arms Act should put a stop to this suit but as that report notes, activist judges have begun gutting it. This suit was filed in federal court in Boston, so I don’t expect good things.
When I was a kid, the idea of recycling became popular. Mind you our elders had been doing recycling for years. Taking parts from one piece of equipment and using it on another, re-purposing things for jobs that they were never intended, but they made it work. I’m blessed, I had grandparents and parents that were really good at it. They didn’t lecture, they just did it and we learned. In the 70s it became trendy though. Now I’m not in favor of littering or anything else like that, I think recycling is great. My point is that we were doing it long before the government saved us by making it trendy or mandatory.
Some things are great for recycling, soda bottles, hand me down clothes, car parts, old wheelbarrows for flower gardens or strawberries. The limit is creativity. Some things however stunk the first time around, and yet are being recycled. Politicians for example.

Had people read Missouri Weapons and Self-Defense Law by Kevin Jamison, they would have known when a prosecutor lies openly and says any 12 year old can walk into a gun shop and buy and Uzi she is not honest, and not on your side. Happily some Second Amendment people tipped off the gun shop, who should have known better, and the even was canceled.

Most families have their own holiday traditions on 4th of July. Normally, they involve fireworks, cookouts, swimming pools, and maybe watching a movie like Independence Day, The Patriot, or Jaws.

Plaintiffs seek an injunction and a declaratory judgment that several federal laws and regulations that prevent federally licensed gun dealers from selling handguns to any 18-, 19-, or 20-year-old violate the Second Amendment. We first find that 18-year-olds possess Second Amendment rights.
The feds will certainly request an en banc review by the full 4th Circuit Court. In the unlikely event that the full court upholds this ruling, The Supreme Court will — once again — be in a crack. Since MCDONALD, SCOTUS has done their utmost to avoid making any truly significant Second Amendment rulings. They won’t want to take this case, so the weasel-wording in dodging should be interesting.
Unless they simply deny cert without comment. Again.
But back to this ruling. I found the reasoning fascinating, because the justices used the very same argument that I have used for years: The Militia Act of 1792, passed less than six months after ratification of the Second Amendment, clearly establishes that 18 year-olds are part of the militia described the Amendment.
Every militia law near the time of ratification required 18-year-olds to be part of the militia and bring their own arms. Around the time the Second Amendment was ratified in 1791, Congress began debating invoking its power under the Militia Clauses to better organize the militias for federal use in emergencies. U.S. Const. art. I, § 8, cls. 15–16. The effort was pushed by Secretary of War Henry Knox, who argued to Congress that while the “military age has generally commenced at sixteen,” the age for the federal select militia should be set at 18 because “the youth of sixteen do not commonly attain such a degree of robust strength as to enable them to sustain without injury the hardships incident to the field.”
I would further note that the current militia composition law, 10 U.S. Code § 246, sets the minimum age a little lower.

I suspect most of The Zelman Partisan’s readers will not be shocked to find out that I consider Democrat/Communist policies in dealing with crime to be utter abject failures. And we are beginning to see some increasingly large failures of the same genre.
First up the required disclaimer. All my children have either four legs and fur, or two legs and feathers. All were home-schooled and are perfectly well behaved, well adjusted fur-children. Let’s start going way back to Skittles and Watermelon Arizona ice tea boy who had been suspected of breaking into houses. He later attacked what the #MSM #FakeNews would label a “White Hispanic” named George Zimmerman. Skittles boy had a history of issues with the law-enforcement. But due to the Obama policy of not relaying information about dangerous students of color to law-enforcement to lower statistics of crime committed by them, he was still walking around, burglarizing, and assaulting freely. As was the Marjory Stoneman Douglas attacker. Because like the Wuhan Flu virus numbers, it doesn’t matter to Democrat/Communists what the outcome will be, only how they can get the #MSM to frame the reports, how they frame the narrative.
That trial and media circus gave rise to Burn Loot and Murder if I’m not mistaken.
Same set of circumstances allowed for the “wayward youth” at Marjory Stoneman Douglas to remain free to slaughter some of his classmates, and allowed the Coward of Broward to become a household name. And then it allowed a self-absorbed, unimportant, attention seeking child, #MoneyHogg to slither his way into the limelight for more than his share of the 15 minutes of fame. A child who wasn’t there when it happened, but jumped on his bicycle as I recall, and pedaled furiously towards the school. Ha! You thought I was heading toward Greta Thunberg didn’t you?
And, what changed? Nothing. There is criminal element of society that can break the law without a worry. It won’t be reported, or it will be covered up. No worries. And this will keep them from being stigmatized. Or forced to get help. Or force their parents to take some responsibility.
And what does that get us? A bunch of 6-11 year olds, I have also heard 7-11 year old “children” who car-jacked a guy running for mayor of Atlanta for those who don’t think Keisha Bottoms is corrupt enough for their liking. Now, this to me, is actually kind of amusing. The councilman voted to defund the police, then lost a fight with a bunch of 6 or 7 to 11 year olds who stole his 2016 Mercedes. He complained it took the police 45 minutes to respond. Apparently a social worker was unavailable. But the carjacking waifs knew a kindred spirit when they jacked one. The Democrat is currently under indictment on charges of wire fraud, mail fraud, bank fraud involving the purchase of a Mercedes C300, as well as a Range Rover.
To Democrat/Communists it’s not important that you be good, moral, decent and competent. It’s important that you fill in the right boxes.
And if you check the right victimhood boxes, you have got yourself a “get out of trouble free” card.
And the idiot councilman? He lives to lie, cheat and steal some more another day. Unlike the poor Uber eats driver that was car jacked and murdered by the 13 and 15 year olds in Washington DC. Also included in the But It’s For The Children column, is the story about the rabid 16 year old who tried to stab two girls to death in front of a police officer while bystanders did absolutely nothing to stop it. An armed police officer, with his gun out, who warned her multiple times to drop the knife and quit trying to kill other people. Unlike some of the other incidents nothing new really came out of that except the constant reminder that some basketball player that reportedly falls down in agony when he has a hangnail criticized the police officer for saving two black girls lives that day. And a little dog. #LDLM.
Policies on how to deal with juvenile delinquents changed? None. Statements from leading Democrat/Communist party leaders condemning the violence and lack of responsibility from both the parents and the children involved? None. Media investigations into what the heck has happened to our society that we are seeing an increase in the number of serious crimes by juvenile delinquents and an increase in severity of the crimes committed. Ho hum, yawn, none. Unless of course there is a defensive shooting by a white police officer. Where upon the media will canonize the utes, despite the better than good chance the utes would bash the news reader over the head, steal their purse, wallet and jack their car if give the chance.
And, problems not confronted and dealt with tend to grow.
The latest incident I’ve heard of involves a 12 year old boy and a 14 year old girl who attacked a attendant/worker at the Florida United Methodist Children’s home. The news report says the girl hit the worker with a stick. Hmm, why do I suspect this sounds more like a beaten employee?
But it seems there is a policy called juvenile justice, and restorative justice. The results of that policy are that a 14 year old who had been arrested for stealing dogs, was sentenced to teen court. She failed to comply. She then set 5 fires in a wooded lot which came close to several homes. The department of juvenile justice then decides that felony arson isn’t a serious crime and to return her to her mother. Her mother can’t control her, so she’s back in foster care, she runs away several times, and winds up in this Methodist children’s home. Which according to the good Sheriff is totally incapable of dealing with this kind of criminals. In fact, in March of this year, a 15 year old boy at the group home pled no contest to the manslaughter charge of a security guard. The sheriff’s department was called to the group home around 300 times in 2020. I would say something in the juvenile justice and restorative justice plan is a serious failure. To make it more exciting for the citizens of Volusia county, though they may not know it, is that same children’s home that couldn’t control these two criminals is taking in illegal aliens from the border.
These two bottom feeders (they are not children) fired what actually may have been a AK-47 and a pump shotgun along with some sort of pistol at the deputies. Now, while those on the left scream about safe storage of firearms, may I refer you to the couple of lines further up. The 14 year old female attacked a group home worker with a stick (who knows, it’s the media, it may turn out to be a baseball bat) and she tried to burned down a group of homes in April of this year. She didn’t need a gun, she just took advantage. I have no doubt had the homeowners been home, they would have needed their defensive tools quickly to have protected themselves from the thugs. Because obviously life means nothing to the perpetrators. The 12 year old boy had done something called “transient threats”. Doesn’t sound too bad, right? Well in this case, it meant the 12 year old in foster care since 2016, had threatened to throw a brick at an administrator and also had 5 days later threatened to kill a student, pee and spread his guts all over the bleachers. For that he was suspended for a whole 3 days.
The Sheriff talked about his team watching as the 14 year old totally destroyed the inside of the home owners nice home. She took a baseball bat and smashed furniture, toilets and anything else she cared to. You think she wouldn’t have smashed people?
The 14 year old told the 12 year old they were going to “roll it down like it was GTA”. I understand that is grand theft auto. A game. I remember hearing Lt Col Dave Grossman talk about this in a class. The effect these violent video games have on children’s brains. They did a series of MRIs showing what was happening. He is co-author of a book about this. Stop Teaching Our Kids to Kill : A Call to Action Against TV, Movie and Video Game Violence Written in 1999 I might add.
But you know one of the things that struck me as the good Sheriff talked about this, was his compassion for the homeowners who had done nothing wrong, and his team who had done nothing wrong. He had compassion for the innocent parties who were just trying their best to deal with the #Shiff that liberal policies are creating and emboldening. It seems rare these days to hear anyone express compassion for the innocent people that weren’t doing anything wrong, just minding their business and going about their lives not bothering anyone or anything and have their lives turned upside down by scum like these 12 and 14 year olds.
I think the media was really struggling wanting to side with the criminals as is their usual game plan.
There is a pattern here. And it’s not limited to America, it’s a pattern consistent with criminals that have learned how to play the game.
Children and Arabs in Israel, hamass.
Both the juvenile delinquents in America who know nothing is going to happen to them, whether they are blm, antifa, run of the mill thugs and the Arabs in Israel, both (some) Israeli Arabs and Gazans know the #MSM and the #UN will run cover for them. Like Commie-Kamala bleating about “root causes” excuses will be made for criminal behavior, illegal aliens with long rap sheets will be turned loose to murder again. The un-ending swarm of 3rd world dependents the Democrat/Communist regime is importing to skew voting and force us to support them as they take American jobs. These polices haven’t worked, and they aren’t going to work, but then they weren’t meant to work for our benefit, only the benefit of those seeking to conquer and rule.
Murderous arabs will have a room in their house destroyed. There is now a cease fire with hamass in Israel, and the can will be kicked down the road.
Israel needs to finish the war with hamass. This cease fire will allow hamass to get more rockets from Iran paid for with American money, and build more terror tunnels. Ceasefires don’t work with hamass because they don’t seek peace, they too seek to rule and their behavior and atrocities will be excused by the same people that excuse the behavior of the criminals in the US.
The deferral of serious consequences for young criminals, regardless of color, age and sex needs to end. It’s not helping. They aren’t being reformed, they aren’t changing path. Restorative justice isn’t working.
But the Democrat/Communist party will double down on their failed policies. Because it’s not about actual results, it’s about optics and appearances.
Who is responsible? Kamala Harris, openly bailing rioters out of jail, the media making excuses for criminals with lethal doses of fentenyl in their system who pointed a gun at a pregnant woman’s stomach during a robbery, a pair of 13 and 15 year old car jackers who killed a man, the justice system corrupted by Democrat/Communists and George Soros elected Prosecuting attornies who turn these criminals lose encouraged the 12 and 14 year olds in Volusia County to think they could shoot at deputies with no consequences. As I listened to the 14 year old cry on the deputies body cam I really didn’t feel much sympathy for her. She chose this, she chose to attack a group home worker who tried to stop them from running off, she chose to break in to the nice house, she chose to try to kill deputies, and she chose to ignore their many offers to make contact and to surrender. See, they have learned in the Democrat/Communist America of Biden and Harris, crime carries no consequences. These juvenile thugs are the people that the “Defund the Police” crowd would abandon us to face disarmed. As I understand it, many of the new gun buyers are first time gun buyers. And seeing what is roaming the streets and our neighborhoods increasingly barren of law-enforcement, who can blame them? Because with this kind of predator, it is protect yourself against them, or they will try to kill you.
And after the pair had fired massive amounts of rounds trying to kill the deputies, as soon as the scene was secured they sprang into action to try to save her life. Because they’re law-enforcement.
And the proof is in the trauma bandages.

I’m sure most people, as I have been, have been appalled and astonished at what we’ve been seeing on the news, at least on the internet. I gave up mainstream media news a long time ago. I can only patiently tolerate so many lies before I lose my temper. I have a low baloney tolerance usually.
Apparently all part of live in the Communist run city of Washington DC. But don’t worry about the girls, they’ll be fine. They got a easy plea deal after pleading not guilty, despite the murder being recorded on video.
Notice how concerned one of them was after they crashed the car. She walked by the shattered body of the dying driver, to get her cell phone from the car. Not even a glance his way. Actually no one around there even went to check on him. The murderers will not be held past the age of 21, nor will they spend any time in a prison facility.
Where are the parents? Where are the politicians elected to keep the cities safe for all? They are supposed to be the responsible adults. The parents brought those beings into this world, the politicians are paid for a job, they are all failing.

But, I’m sure if you talked to their parents, they would say something similar to what the “mother” of the attempted murderess in Columbus said of her daughter.

The first girl she attempted to stab that fell down was kicked in the head by the man in grey. Yeah boy, he’s special. He kicked a girl in the head when she was trying to get up. The aspiring murderess then goes after the girl in the pink outfit carrying a little dog and is seconds away from stabbing her when she is shot. So, how crazy do you have to be to try to kill two people in front of a police officer who is telling you to stop and has his gun out? Then the man who kicked the unarmed girl in the head who was trying to get up unloads verbal abuse on the officer after he is forced to put down the aspiring murderess like a rabid animal. Perhaps he and his mouth should have gone and kicked the knife out of the murderess’s hand instead, eh what?

At the end of the first video the neighborhood (some of) is up in arms about a white police officer saving the life of the girl in pink. Her black life didn’t matter so much, nor did the black life of the girl in shorts she tried to stab first. I haven’t heard much of anything about the girl in pink, who I’m shocked the news (hahahaha, I know, I crack myself up) media hasn’t tried to get a comment from. But there is this.

Tucker Carlson did a segment talking about the response from, how shall I phrase this? People who have no actual experience or knowledge in the field of law-enforcement throwing their ignorance out there on full display. I start the video at that part.
This excusing of violent, rabid animals that have no sense of right and wrong, good and bad is not working out well. There is an old saying “Keep doing what you’re doing and you’ll keep getting what you’re getting”. Well, we are getting a culture of crime, where life is dirt cheap. And the thing of it is, if it had been the aspiring knife murderess who was being attacked by the man in grey with a ballpeen hammer, she would have wanted that same cop to have stepped in and saved her. After this, would he? How many officers will now hesitate to step into that breech? How does this make life safer for anyone? How does this make a better, more civil society? How does it bring us together as a united nation?
Our culture has come very distorted. What is right is called wrong by much of the media, and loud mouthed ignorant politicians who encourage more violence. They are attempting to divide us by color as good communists do and as Charles Manson predicted. And gullible people who would have benefited under the previous administration celebrate the loss of their opportunity to do so.
And yet, to the communist left, the answer is to destroy the Constitution and strip law-abiding Americans of their Second Amendment rights to defend themselves against the feral animals that roam the streets looking for easy prey. Huh, guess we know their desired voting block and it’s not decent people.
There are people that have addressed part of the problem.

People who carry out mass shootings at schools in particular tend to be boys who are suicidal, depressed, and dad-deprived.
I can’t help but wonder if that doesn’t play into this as well, along with a culture that excuses violence towards others. For some, because some animals are more equal than others.

My First Knife Fight
Pray for our country. Pray that sane, responsible leaders will be elected. Pray that their will be just consequences for those that break the actual law, not whatever the communists determine it is this hour. It’s for the children.
As the suit says, Monroe County is suing IFC and a county resident. Specifically, the suit is over a Chief Justice order barring firearms from court houses, and a state law that says if you do that, you must provide security. I jumped right into the filing because I really wondered how the heck the county was going to rationalize a claim against those defendants.
And… I don’t see a claim against them.
I need someone smarter than myself to explain this to me. The obvious unofficial backstory makes it clear that the county is maliciously targeting IFC and Thompson because they warned the county to comply with the law. But the only way the court filing addresses the official defendants is this.
STATEMENT OF THE IOWA FIREARMS COALATION (sic) AND MR. THOMPSON
30. Monroe County, Iowa has been advised by the Iowa Firearms Coalition that if it continues to comply with a lawful Order of the Iowa Supreme Court, that it will impose this unfunded mandate upon Monroe County, Iowa or that Monroe County, Iowa will be liable for this unfunded mandate plus attorney fees and other costs allowed by HF 2502. Monroe County, Iowa denied Mr. Thompson’s request.
31. No personal judgement is sought against Mr. Thompson.
WTF? There’s no actionable claim. They only say that IFC warned them they should comply with the law. Thompson gets no mention beyond that he made an unspecified — in the filing — request. Neither IFC’s nor Thompson’s warning/request is included in the filing. So even this vague soeta-claim is unsupported.
Other than that, the whole thing is a claim against the state for an unfunded mandate imposed by HF 2502. But even that is bogus. There’s no mandated expenditure; all they have to do is not declare a gun-free zone. If they choose to do that, then they voluntarily accept the expense. It would like Joe Blow calling vehicle registration fees an unfunded mandate; it isn’t because no one has to pay it unless they choose to buy a car.
This reads like a case against the state, and some office intern accidentally listed the wrong defendants. And even then, the alleged unfunded mandate would have been imposed by the Chief Justice who issued the gun-free order. Including IFC and Thompson has no point — legally; unofficially, it looks like retaliation for protected speech — but to make them pay for the county’s suit against the state.
OK, smarter people; what have I missed?

The ATF is reportedly working on redefining “firearm” to include unfinished “80%” frames and receivers. And I am getting really tired of this.
18 U.S. Code § 921(a)(3)
The term “firearm” means (A) any weapon (including a starter gun) which will or is designed to or may readily be converted to expel a projectile by the action of an explosive; (B) the frame or receiver of any such weapon; (C) any firearm muffler or firearm silencer; or (D) any destructive device. Such term does not include an antique firearm.
27 CFR § 478.1
Firearm frame or receiver. That part of a firearm which provides housing for the hammer, bolt or breechblock, and firing mechanism, and which is usually threaded at its forward portion to receive the barrel.
That definition is already causing judges to toss firearm possession cases, where the defendant possessed AR lowers, which the ATF willfully and dishonestly calls “firearms.”
True, that does provide housing for the trigger group and hammer. But note the lack of the rest of the firing mechanism, the firing pin. That goes in the upper, which is not considered a firearm. No does the lower house the bolt/breechblock. It doesn’t even have an attach point for the barrel. One characteristic out of four magically makes it a “firearm.”
Judges disagree.
The upper, though, houses the bolt/breechblock, the firing pin, and has the attach point for the barrel. Three out of four of the firearm characteristics doesn’t make it a firearm?
So the ATF already has a judicial problem with the current effing arbitrary redefinition. And now they want to — totally without any lawful authority — to expand it to include unfinished frames/receivers/lowers-to-be.
Lessee… no barrel attach point, no place to put a bolt/breechblock, no place to put the trigger group and hammer.
Try telling the judges, who don’t believe that a finished and assembled AR lower is a firearm, that this paper weight is. Try telling them that the ATF has the lawful authority to pull that redefinition out of its… lower cranial storage orifice.
Currently, even with our corrupted court system, I don’t think this change will survive a challenge. But if the ATF draws out the administrative process of rule-making then Bye-BidenHarris may be able to install a sufficient number of anti-constitutional judges to uphold it.
Alternatively, with the Dims holding both House and Senate (senate president Harris, you know), and the White House, they could do this this legislatively for once.
