When Rights are Privileges

As you may, or not know, the United Nations has claimed there is no human right to self-defense.

Does a woman have a human right to resist rape or murder? Do people have a human right to resist tyranny? The United Nations Human Rights Council has said no – that international law recognizes no human right of self-defense. To the contrary, the Human Rights Council declares that very severe gun control – more restrictive than even the laws of New York City – is a human right.

Unless of course, one is a member of the U.N.

Nothing in the present Charter shall impair the inherent right of individual or collective self-defence if an armed attack occurs against a Member of the United Nations, until the Security Council has taken measures necessary to maintain international peace and security. Measures taken by Members in the exercise of this right of self-defence shall be immediately reported to the Security Council and shall not in any way affect the authority and responsibility of the Security Council under the present Charter to take at any time such action as it deems necessary in order to maintain or restore international peace and security.”

I would maintain that this is because the U.N. thinks they are G-d. G-d has a different command.

So, what has set me off on this? An incident that happened in formerly red state Texas. And maybe Texas is still a red state, Austin however, is not. If Texas had any sense they would expel Austin.

In July 2020, during the summer of riots for a man that overdosed on drugs, had a criminal record including pointing a gun at a pregnant woman’s stomach, a BLM/Antifa rioter decided it would be a great idea to point a loaded rifle at a soldier who was working as a ride share driver. Apparently BLM/Antifa scum thought he would be the only one armed. He guessed wrong. Sgt. Daniel Perry was armed. When his car was surrounded after he had dropped his passenger off, and aforementioned BLM/Antifa rioter pointed his rifle at Sgt. Perry, Sgt. Perry shot him. This seems sensible to me.

This will be the last sensible thing in this saga for some time.

The Travis county jury found Sgt. Perry guilty of murder. Unbelievable. But wait, there’s more.

Texas Governor Seeks to Pardon Army Sergeant Convicted of Killing Gun-Wielding Protester

Texas Gov. Greg Abbott said he is seeking to pardon the U.S. Army sergeant who was convicted of shooting dead a man wielding a gun at him during a Black Lives Matter protest in 2020.

Abbott announced on April 8 that he will pardon Sgt. Daniel Perry, 37, who was working for Uber in Austin at the time, as soon as a request from the state’s parole board “hits my desk.”

I would say our criminal justice system is well and truly jacked up. No ammo or guns were banned, it’s just if you defend yourself they will try to bankrupt you, or put you in jail for defending your life. If you’re not one of the BLM/Antifa rioters, or a repeat offender criminal, those they do catch and release.

Sometimes I read threads on Quora, there are discussion thread on all kinds of things. You might be reading a thread on a TV show, and the next thread under it is a question posted about “what would happen if I decided to take a gun away from someone I saw carrying” “Is there any reason I and some friends shouldn’t follow someone into a bathroom we know is carrying a gun and take it away from them”. “When will gun owners admit their right to have their weapons of death should not interfere with my right to feel safe”.

It is absolutely appalling to me the number of people that think they have the right to forcibly take private property from someone they don’t know, they aren’t doing anything wrong, and these moonbats think they are well within their rights to attack someone and steal from them. Thank you colleges, universities and MSM aka #FakeNews. If anything ever was a argument for concealed carry, it’s this sort of thing.

There is NO common ground to be found with these people. None.

If A Tree Falls In The Forest

You know the old saying, if a tree falls in the forest and there is no one around to hear it, does it make a sound? Or something like that…

If a right exists but it is ignored or not acknowledged, is it still a right?

G-d gave us a beautiful world, he gave a contract, that if followed, we could live in harmony with each other and he will dwell among us. The left hates that, they want the worship due to G-d and they want to push him as far out of his world as possible.

But these rights? They still come from G-d, they left may act as though they give and take them, but that’s not how it will end up. They can ignore our rights, they can act as though they don’t exist. But G-d gave them to us, their opinion does not nullify his gifts.

Even if I had a crystal ball, it would probably look more like a shaken snow globe right now, things are so crazy, but here, here is one thing I know. There are elements within the legal system in Israel that are starting to stand for the rule of law, there are elements of the legal system within America and I think the good people of both have about had their fill of being used and abused by a corrupt legal system. Emmy the non-lawyer is an elected official. I hope the people of Arizona can do better. I’d like to see Emmy removed from office, tomorrow. You know, in the Second reading above, God fearers, men of truth, who hate monetary gain, I’m very curious, who paid for Emmy’s campaign? Does Emmy have any other source of income? Raising The Cane

I saw this article recently about a feral 13 year old attacking a teacher in Georgia and breaking her leg. This really is unbelievable to someone like me who was raised with “If you get in trouble at school? You’re in way more trouble when you get home!” And they weren’t kidding. My parents weren’t cruel, if something happened they would give a chance to explain your side of what happened, but they were not the parents that showed up to school saying “My little Princess would never….so fire the teacher”. Not them.

Who let a child grow up to be like that? The feral animal obviously has no moral compass, no intellectual curiosity for learning and is going to be nothing but a drain on society at this point. So many positions, not just law-enforcement, are now based on skin color, gender, and gender perceived (by them), and a host of things other than job qualifications and experience that we now understand why there are things like baby formula shortages, unexplained food supply chain attacks with apparently no interest from the federal government and a pharmaceutical industry that now controls the Mainstream media (propaganda wing of the demoncrat party). Because performance, quality and result don’t matter, only equity does.

In addition to dealing with feral unwanted 13 year olds, and antifa the spawn of rich white demoncrat parents, the police also have to deal with Joe Biden’s (I’m sorry, I didn’t have a chance to see what stock in Biden is going for today before I started this column, but keep an eye on his stock value, it may be changing) millions of illegal aliens.

Illegals Housed at Taxpayer Expense Refuse to Leave NYC Hell’s Kitchen Hotel for New Shelter

Yes, the illegal aliens that broke into the country who demoncrats assure us just want a job and to work and pay their own way are refusing to the leave one of the taxpayer funded hotels. Law enforcement is far from the only branch of the law that suffers from low standards due to poor quality in education. Remember the part about “wise judges?” Well, Joe BidenTM hasn’t met a stupid judge he doesn’t love and want to nominate to a position where they can further destroy some part of America. This nominee for “Judge” can’t say what Article V and Article II of the Constitution are. Yep, this is who Joe BidenTM nominated this time. It’s like a game to them. G-d bless Senator John Kennedy, he didn’t laugh or cry, which I see as pretty commendable at this point. The comments under the video are a bit of a bright spot though.

This is actually not so much a pro-law-enforcement column as it is column on the state of the legal system really. So let’s take a look at what happens when you have crappy cogs in the wheel. Do you remember this from August 2021, a 15 year old in Venice Kalifornia stole a car, was driving down an ally the wrong way and intentionally ran over a young mother out walking her baby in a stroller, and then drove off. Mercifully he was caught but only because an absolute knight in a pickup truck saw the whole thing, realized what was happening an in a sweet spot of timing, put the stolen car into a light pole an then pinned it, so they caught the criminal.

And so, George Gascon, a Soros bought DA rather than sending him to prison, even kiddy prison, sent him to juvenile camp, for 3-5 months. No word if George kissed him on his widdle head or packed his socks for him before he sent him off to camp for his “soft on crime” sentence.

But you know, sometimes, some things are just so outrageous that forces beyond the norm intervene. I realize I should probably try to sound sad about this, but we’d all know I was being dishonest. The kid tried to kill that woman and that innocent little baby.

After Fay came back he didn’t exactly straighten up and fly right, so they probably should have given him the whole six, who knows? But eventually he did get his act together. CNN shows us every time they go after some poor law abiding family that was just praying in public, at a school board meeting or some such Merrick Garland didn’t like because it threatens his son in law’s income. So the agents are lined up and told “No migrant gets past YOU” Simple rule, not one migrant gets in. The first migrant that gets past you? You’re in the next airdrop to the Ukraine. I mean our federal debt will never recover from what Joe BidenTM and the demoncrats have spent the last few years, we’ve got to cut expenses somewhere. Maybe some of these creative ideas can help trim the budget, lower crime and help undo some of the illegal alien invasion were enduring. Next week maybe I’ll cover coupon clipping!

Covid Trials (and Tribulations)

So my 93 year old Mom went to the Big City Medical Center on October 3rd, her 93 birthday, September 28th, was spent in her small apartment with her double injected and recently boosted younger sister and her daughter (Mom’s niece) a few days later she had a cough. For all my life I will regret that I was starting a 3 in a row stretch at work. Two days later she was taken to Big City Medical Center with WuFlu. The only good thing I can say about Big City Medical Center is they allowed one visitor a day for one hour.

My Aunt, not Mom’s sister, my Dad’s sister, lives a couple of floors up. They usually eat their meals together in the dining room. The day Mom’s younger sister came to visit with her daughter for the day my aunt came down and ate with them, then went back to her own apartment so she wasn’t around them that much. To my knowledge, no one else in the building has developed WuFlu within a close time frame. Neither Mom or my aunt are injected for different reasons. And since part of the people I take care of are double injected and boosted and I’m still taking care of them tells me enough. So what I’m saying in a round-a-bout way here is yes, I think Mom’s sister and her daughter shed their little spike proteins all over and Mom caught it, and yes that’s a real thing. Ignore the snopes one, they’ve been debunked as a website fact checking service. Then there is this

So on to Big City Medical center the ambulance took her. I had to work that night, but was able to see her the next two days. It was all I could do to keep from saying “Well, aren’t you the stupidest little cow in the pasture”, but I’m trying hard to do better. Yes, Lasix will make her pee and do not a dang thing to protect her kidneys from the damage caused by Remdesivir.

Every single thing Big City Medical Center did to my Mom was according to the Fauxci protocols. May he be swinging from a rope soon as the others who perpetrated medical experiments on unwilling subjects did. Nuremberg 2.0 can’t come soon enough. But back to Big City Medical Center, they followed the protocol to the letter. No Ivermectin, yes Remdesivir. Mom occasionally has a cough, she did before WuFlu and asked for sugar free honey lemon cough drops. I asked the nurse if I could bring some in. She said she would ask the doctor. I sat there and thought “Awesome! All those years of medical school, the mountain of school debts, the sleepless nights and your sole choice is now can the patient have a sugar free lemon cough drop. Wow, Fauxci has really destroyed the practice of medicine.”

Don’t even get me started on them whacking her with Zyprexa. Yes, it has it’s uses, but right patient, right dose is kind of important. If what you gave your patient makes her unresponsive for 3 days, you screwed up. Pro-tip? Don’t attempt to prove the patient is indeed responsive by pinching the webbing between her thumb and finger under the bed cover and when she grimaces and withdraws her hand try to tell the daughter sitting there you didn’t that you were just “stroking her hand”. I’ve been in the game longer than you’ve been alive bitch. I know what “responsive to pain” is.

I realize this column is more disjointed than usual, but should you or someone you care about wind up in “Big City Medical Center” I want to pass a few useful things along. Although I’m pretty sure this won’t be the last column dealing with WuFlu, because, you see that is the tool to enact the tyranny. Kyle Rittenhouse Trial Approaches

The trial of the young man who was attacked by three different Antifa/BLM/Democrat storm troopers begins Monday, 1st November.

In this day and age when words can be changed to mean whatever the social media giants, mainstream media aka #FakeNews attempt to twist them to mean, I find it a tiny bit encouraging that the judge in charge on the trial has said some very sensible things.

Judge Bruce Schroeder has standards, like actual guidelines that he follows and it doesn’t seem to matter to him what color the people are, what socio-economic level or anything else. They are like these principles that you apply to events. Shocking these days indeed.

Judge Schroeder has ruled that the prosecution is not allowed to call the three men that tried at various times to attack Kyle, or to shoot him “victims”.

Considering that the prosecution (someone that used to be interested in the law, and taking the side of law-abiding citizens) argued that just because one of the storm troopers was trying to burn down a gas station didn’t mean he deserved to be shot by Kyle, because just burning down a gas station doesn’t have anything to do with Kyle. Actually I believe it did. But if that’s the prosecutions approach probably a good thing the judge explained to him why you can’t call them victims.

Judge Schroeder stated the term “victim” is “loaded” because it assumes a degree of guilt by a defendant.

He did say they could call them arsonists, looters or rioters. Presumably because that is acts they were engaged in during the encounter.

He said the prosecution could elevate them to Fauxci level of sainthood if they thought it would help their case. Ok, I made that comparison up. But he did say they could “beatify” them. The judge seems to think the “victimhood” business will be decided by a jury, not the prosecutor who thinks “it’s just arson” or the MSM aka #FakeNews. Shocking eh what?

The trial is to determine did Kyle have reason to believe his life was in danger. I don’t think anyone who saw the video could come to any other conclusion.

This video is still up for the moment. It’s an eleven minute video with a timeline talking about what happened. It’s a good video, I think Lin Wood may have had something to do with the defense at this point. You will have to jump through about three hoops to see it.

It wasn’t the first time a conservative figure had been accused of such. Herman Cain, Bill O’Reilly, Judge Roy Moore, Judge Brett Kavanaugh come to mind, and the media covered it non-stop. Although Kavanaugh is different. In the first cases those men either dropped out of the political race they were in, and O’Reilly left his TV show. They tried it with Sean Hannity and he said “bring it”. They did, and he informed them he would fight it and sue, they decided to leave him alone and dropped it. In Judge Kavanaugh’s case, he rode it out, as has President Trump. Governor Greitens did not. While he was prosecuted with tax payer dollars, he had to pay for his own defense. But in all those cases, when the men stepped aside the story just went away. In Kavanaugh’s case it was also different in that while it was on-going some of accusers began to be exposed as lying.

I think this is when I began to get really testy about knee jerk reactions. When the Greitens case was flooding the #MSM #FakeNews airways there were already people saying “Wait a minute, something is off here”. Lt. Col. Dave Grossman, whom I mightily admire did a couple of columns during the situation.

Wait! What! The Demoncrat prosecutor/political hack Kim Gardner lied about evidence, hid evidence, hired a retired FIB guy who also lied about evidence. I know, it’s like that movie “Groundhog Day” isn’t it?

Missouri Gov. Michael Parson (R) said Monday that the state will accept refugees after President Trump signed an executive order allowing governors to opt out of doing so, according to the St. Louis Post-Dispatch.

What? Missouri didn’t have a high enough crime rate? Needed more people for the taxpayers to support? Of course they may assimilate and become useful citizens, but I somehow think that Missourians might not be all that thrilled. Though Parsons isn’t the only one.

But Minnesota is not the only state that has been affected by an influx of “outsiders”. Look at Virginia. It used to be a nice state, lots of nice horses, lots of nice places to ride. Oh, I’m sure it had other good qualities as well. For example it used to be sane. As in respecting the rights of individuals as recognized (not granted) by the Constitution and the Bill Of Rights. Rights that are granted by G-d, not government. But all that has changed. There has been an influx of progressives, and they’ve changed who gets elected and who gets elected is who writes and votes on laws. For the last few months we’ve been watching gun owners in Virginia wage a desperate battle to hang onto their Second Amendment rights.

But it will not end with Virginia. Virginia is not the only state under attack, it is part of a bigger plan. And like the Wuhan Corona virus, it can be there for awhile before the state even realizes it’s been infected. There is a book on the plan to turn Red States into Purple States. Blueprint

Missouri does have a piece of legislation pending that may help them, although it wouldn’t prevent a Virginia style takeover. It is an excellent bill called “Second Amendment Preservation Act (SAPA)”.

Last I heard is the Bill is doing great in the house with 86 co-sponsors, but in the Senate a Senator named Doug Libla who is Chair of the Transportation, Infrastructure and Public Safety Committee is holding it up. Seems he insists it be watered down. Now one would think this Sen. Libla would be a Demoncrat, but he’s not. He’s supposed to be a Republican. I guess he’s one of those “Trans-Republicans” like Mittens Romney.

Duty? What Duty?

As a child growing up, most of the TV shows tended to portray law enforcement as heroes. They always got there in the nick of time, and if they were called in after the unfortunate event happened? They always knew what to do about that as well. They could do a dandy chalk outline of the corpse and then find out who made that happen to the unfortunate victim. And the really superior thing about law-enforcement back then is they could always make it happen in an hour. Minus the time for commercials of course. That’s not like the modern day shows that have running story lines. Like soap operas did when I was growing up. This is back before the day of “Cops as the bad guys”. Oh of course there have always been bad cops, it’s just they weren’t really so much a part of the TV land experience back then. We were taught to respect them, and if we were in trouble, look for a cop. TV shows where the guys stealing cars were the good guys didn’t happen. Nor was there near the amount of realism that you see in shows today.

Hospitals probably weren’t target rich environments back then, aka “gun-free zones”. But to be honest, I doubt that many people carried while at work either. It’s just that now the signs make it clear unless the crew of “Third Watch” happens to be in the ER waiting room they can pretty much be assured everyone will be doing what the medical staff was doing. Ducking, hiding, running, praying. Because throwing chairs, rocks and baseball bats don’t look to be a viable option to me there. No one is going to be firing back at them.

So if the crew of “Third Watch” happens to be in the ER waiting room, and 1-Adam12 has been dispatched to assist in response to Cruz’s call in for back up, how long will it take for Malloy and Reed to arrive on the scene?

Average-Police-Response-Time to a 911 call?

“I would just call 911 for help.” There’s this false sense of security that we have created with the 911 system that has people believing that with a single call, a swat team will be dispatched immediately to save you and your family within moments of the call.

Unfortunately, this couldn’t be further from the truth. So what is the average-police-response-time to a 911 call?

According to American Police Beat, the average response time for an emergency call is 10 minutes. Atlanta has the worst response time with 11 to 12 minutes and Nashville comes in at a lightning speed of 9 minutes.

The Department of Justice, with their statistical prowess, reports that the best response time is 4 minutes and the worst over 1 hour. Interpretation? If you live in an upper income area you probably are privy to the 4 minute response time, while middle to rural areas will see a much longer response time.

Now here is where things get interesting. Even though the Department of Justice determined that the average police response time to a 911 call is 4 minutes, the average interaction time between a criminal and his victim is 90 seconds.

That translates to you being robbed/injured/maimed/raped/murdered and waiting for an additional 2 and a half minutes for the police to arrive. The truth of the matter is that the police will almost always arrive AFTER the crime has happened and the criminal has gone.

In rural areas the time can be even longer. A lot longer. Think 30 minutes, maybe more. It’s not that they are hanging out at donut shops, or trying to get someone at Taco Smell to take their order, there is a lot that goes into 9-1-1 calls, and a lot of calls can go into 9-1-1. The lady with the cat in the tree may have got a call in seconds before you were calling in about the guy fixin to come in through your back door.

Actually, school shootings seem to have an even worse set of numbers. Quicker Response to Active Shooters

There are four possible ways to mitigate the damage inflicted by an active shooter. You can harden the target, arm and train potential victims, strengthen prevention programs and suspect identification, and improve law enforcement response times. Each one of these steps is easier said than done because of the associated bureaucratic, political, and budgetary considerations.

Department of Homeland Security research reveals that the average duration of an active shooter incident at a school is 12.5 minutes. In contrast, the average response time for law enforcement is 18 minutes. That means it only makes sense for us to find ways to improve our response times. Working on our response times is about the only anti-active shooter measure that we can take at the operator level. We must find a way to shave off some time and in doing so, create some type of tactical advantage.

A little discouraging that political weighs into the mix making it harder. But when you consider two Buckets O’Chum in Florida were part of Barry’s social engineering project where by kids got a pass on criminal behavior to make statistics look better and law-enforcement agencies got money in return, I guess it’s the truth. Both of them had criminal actions in their backgrounds. Were they in jail? Juvenile court? Detention? Nope.

But you know what the bottom line on all of this is? They don’t gotta. What do I mean? They police do not have a duty to protect you, yours, your kith or your kin. Or Barbie either for that matter. I know, I know that’s what it says on the side of the Police cars, “To Serve and Protect”. Look, everyone needs a goal, a mission statement if you will. So think of it like that, it’s a goal, it’s their mission. Mine is to lose 7 pounds. They have equal chances of succeeding. They can’t be everywhere at once and fried okra still exists in the world.

This has become an issue again the wake of the actions of the law enforcement of Coward County Florida. Scot Petersen, not the Scott Peterson who murdered his pregnant wife, he’s still on death row, but the deputy who cowered outside as a Bucket O’Chum shot students in a Parkland school after security monitor Andrew Medina failed to confront O’Chum when he saw him or call a “Code Red” in the school. So, because Parkland is a safe gun-free zone and had the crack Coward law-enforcement on hand you have a massive #GunControlFail.

It should be no surprise some of the parents sued.

A judge has rejected a deputy’s claim that he had no duty to confront the gunman during the school shooting in Parkland, Florida.

Refusing to dismiss a lawsuit filed by the parent of a victim, Broward Circuit Judge Patti Englander Henning found after a hearing Wednesday that ex-deputy Scot Peterson did have a duty to protect those inside the school where 17 people died and 17 were wounded on Feb. 14. Video and other evidence shows Peterson, the only armed officer at the school, remained outside while shots rang out.

The negligence lawsuit was filed by Andrew Pollack, whose daughter Meadow was killed. He said it made no sense for Peterson’s attorneys to argue that a sworn law enforcement officer with a badge and a gun had no requirement to go inside.

“Then what is he doing there?” Pollack said after the ruling. “He had a duty. I’m not going to let this go. My daughter, her death is not going to be in vain.”

That lasted a week. Cops and schools had no duty to shield students in Parkland shooting, says judge who tossed lawsuit

Bloom ruled that the two agencies had no constitutional duty to protect students who were not in custody.

“The claim arises from the actions of [shooter Nikolas] Cruz, a third party, and not a state actor,” she wrote in a ruling Dec. 12. “Thus, the critical question the Court analyzes is whether defendants had a constitutional duty to protect plaintiffs from the actions of Cruz.

“As previously stated, for such a duty to exist on the part of defendants, plaintiffs would have to be considered to be in custody” — for example, as prisoners or patients of a mental hospital, she wrote.

But this isn’t the first time such a case has come up. In an excellent book on Missouri Weapons and Self-Defense law the author talks about Warren vs. District of Columbia. This was such a horrible case it always stuck with me.

Police are not the only ones shielded from the consequences of the failure to protect. Another truly horrific case is that of DeShaney v. Winnebago County. That was a spectacular failure of a ‘child protection team,’ consisting of a pediatrician, a psychologist, a police detective, the county’s lawyer, several DSS caseworkers, and various hospital personnel, and the juvenile court. They returned a badly abused child to his custodial father. The father did not meet the requirements in the following year and the child protective services did______________nada, zip, zilch, zero, squat. Eventually the poor little four year old boy was beaten so badly he wound up in a institution for the rest of his life. His dad served less than 2 years in jail. And the child protection team? The department of social services that did nothing on their follow up visits? Nothing, nothing happened to any of them when the child’s mother attempted to sue. I’m thinking the court that awarded custody to the dad should be included in the list of shame there as well.

And what say the anti-gun, anti-self defense pink hatted faux feminists? Don’t get a gun, just go through the legal system. Get a restraining order and then sic the cops on him. And Town of Castle Rock v. Gonzales will show you that works as well as the law enforcement team of Coward County. That resulted in 3 dead little girls at the hand of their loving father. The mother had begged police to go find the girls. Her ex walked right through the paper target.

This reality does belie the often-made claim, however, that police agencies deserve the tax money and obedience of local citizens because the agencies “keep us safe.”

Nevertheless, we are told there is an agreement here — a “social contract” — between government agencies and the taxpayers and citizens.

And, by the very nature of being a contract, we are meant to believe this is a two-way street. The taxpayers are required to submit to a government monopoly on force, and to pay these agencies taxes.

In return, these government agents will provide services. In the case of police agencies, these services are summed up by the phrase “to protect and serve” — a motto that has in recent decades been adopted by numerous police agencies.

But what happens when those police agencies don’t protect and serve? That is, what happens when one party in this alleged social contract doesn’t keep up its end of the bargain.

The answer is: very little.

The Mises Institute also makes another excellent point.

The taxpayers will still have to pay their taxes and submit to police agencies as lawful authority. If the agencies or individual agents are forced to pay as a result of lawsuits, it’s the taxpayers who will pay for that too.

Oh sure, the senior leadership positions may change, but the enormous agency budgets will remain, the government agents themselves will continue to collect generous salaries and pensions, and no government will surrender its monopoly on the use of force.

No government will surrender it’s monopoly on power? Well what I ask, could go wrong with that??

Venezuelans regret gun ban, ‘a declaration of war against an unarmed population’

“Guns would have served as a vital pillar to remaining a free people, or at least able to put up a fight,” Javier Vanegas, 28, a Venezuelan teacher of English now exiled in Ecuador, told Fox News. “The government security forces, at the beginning of this debacle, knew they had no real opposition to their force. Once things were this bad, it was a clear declaration of war against an unarmed population.”

Under the direction of then-President Hugo Chavez, the Venezuelan National Assembly in 2012 enacted the “Control of Arms, Munitions and Disarmament Law,” with the explicit aim to “disarm all citizens.” The law took effect in 2013, with only minimal pushback from some pro-democracy opposition figures, banned the legal commercial sale of guns and munitions to all – except government entities.

Ancestry, 23andMe, In Handcuffs

I ran across a column a last night about how police can use those commercial DNA company data bases to try to solve crimes. You know, the ones with the cute commercials with the guy who thinks he is of a certain ethnicity and by the end of the commercial he’s wearing lederhosen? Or somebody ends up playing the bagpipes. I love bagpipes, so I don’t mind that, as long as they do it well. So people wanting to connect with their past, send in their DNA, and find out their origins, or some of their origins.

I’ve never sent my DNA into anything. I just sort of thought well, once someone has your DNA, they have your DNA. It’s a bell that can’t be un-rung. But I thought the column interesting, so I posted it to FaceBook. I got some interesting comments. One person pointed out they will delete your profile if you ask. Another pointed out that it’s like NICS deleting the information. I would agree with that assessment, somebody else commented Orwell lives. Indeed. And what could be wrong?

Well, what a co-inky-dink! I happen to watch a TV show tonight, 48 Hours I believe. Guess what it was about! DNA. Well, I must watch this.

The case involves the murder of Angie Raye Dodge. A young, beautiful woman not even yet 20 years old. She had moved out from her Mom’s home and got her very own apartment a few weeks before she was murdered in Idaho Falls on June 13, 1996. She hadn’t shown up for work and one of her friends went to check on her and found the body and called police. Idaho Falls having a small town feel, where neighbors likely know each other was horrified. The pressure was on to catch the killer who stabbed Angie to death and cut her throat. As I recall, the report said there was no sign or forced entry, she was found with her throat cut, partially naked, raped and someone had ejaculated near the body. The sample would be known as a pristine profile, meaning one man, to the exclusion of everyone else on the planet. So what could go wrong?

All the locals were checked, no matches. Her mother Carol, was desperate to find the killer, so in 2014 she called Dr. Greg Hampikian,and said the police can’t find my daughter’s killer. So he got involved. Dr. Hampikian is a DNA expert. The police had DNA, they just didn’t have any local matches, and there were no matches in CODIS, the Combined DNA Indexing System. Carol wanted to use a new DNA technique called Familial DNA matching. Meaning, ok, it’s not you, but maybe someone in your family. In other words, sort of a “close enough for government work” plan. Some states, Maryland and DC have laws against doing familial DNA criminal data base searches. Idaho forbids doing familial DNA searches of it’s criminal data base. So Dr. Hampikian, proposed something, using “public” data base searches. Such as those used by Ancestry and 23andMe to do the familial DNA search. What could go wrong with that?

Dr. Hampikian is probably a brilliant DNA researcher, but I think he’s a tad bit on the drama diva side. So they did their search and got a hit, 34 out of 35 markers. Which sounds like a lot. It was deemed a solid lead. It came back to the family of Michael Usry. Now lets look at how the data base got Michael Usry’s DNA in the first place. He had submitted it as part of a church genealogy project. Voluntarily.

Seemed like it shouldn’t be a big deal, I mean, it’s a church genealogy project, not a poster on the Post Office wall. What could go wrong with that?

The cops chose to use a lab linked to a private collection of genetic genealogical data called the Sorenson Database (now owned by Ancestry.com), which claims it’s “the foremost collection of genetic genealogy data in the world.” The reason the Sorenson Database can make such an audacious claim is because it has obtained its more than 100,000 DNA samples and documented multi-generational family histories from “volunteers in more than 100 countries around the world.” Some of these volunteers were encouraged by the Mormon Church—well-known for its interest in genealogy—to provide their genetic material to the database. Sorenson promised volunteers their genetic data would only be used for “genealogical services, including the determination of family migration patterns and geographic origins” and would not be shared outside Sorenson. Its consent form states:

The only individuals who will have access to the codes and genealogy information will be the principal investigator and the others specifically authorized by the Principal Investigator, including the SMGF research staff.

Despite this promise, Sorenson’s vast collection of data, like data in other public DNA databases, is available online and may be searched by anyone with “DNA results obtained from a commercial lab.” This means, without a warrant or court order, investigators were able to run the crime scene DNA against Sorenson’s private genealogical DNA data.

So how did Chris Tapp become a suspect?? Well, a friend of his Ben Hobbs was arrested in Nevada for raping a woman at gun point. So they looked into Ben’s friends and came up with Chris Tapp. Then we have our second variety of what could go wrong? The first being using familial DNA.

Chris was interrogated something 9 like times in 23 days and underwent 7 polygraphs. His story changed six times. Yeah, I realize people can change their stories, but apparently this was more than that. In some of the video clips it does appear the police are leading him to the answers they want. It went to trial and he was convicted of murder and rape and sentenced to 30 years to life. Remember, this guy had no DNA match at the murder scene or any other physical evidence present.

Michael Usry, 18 years after the murder has two Idaho Falls Detectives and Louisiana State Trooper show up at his house saying they’d like a word. He goes downtown with them, has no clue what this is all about so he’s cooperating a bit blindly not understanding what this is all about. Then in questioning they mention the murder mystery movies he makes, very scary stuff, and by the way, it’s about a murder case in Idaho Falls, open wide were going to swab your cheek. He has no lawyer present and still not much of a clue. They take him home, drop him off at the curb bewildered and dazed. He calls a friend, who in 20 seconds of searching tells him about the Angie Dodge murder case. The 15 years before DNA his Dad submitted for the Church project has come home to roost and poop on the head of the son.

Michael was so horrified and incensed by what Ancestry had done to him, he decided to do what he does, and do a documentary on this issue. But after he met Carol Dodge, who agreed to meet with him, despite thinking someone in his family must have murdered her daughter, because, you know, DNA said so, he changes to documentary to be about Angie’s murder. Then Mike wondered why anyone would confess to a crime he now says he didn’t commit. So he met with Chris and became convinced Chris hadn’t done it. Yes, this is a bit shortened. By this time Carol is convinced Chris did not kill her daughter and wants him freed, Michael doesn’t think Chris killed Angie, and Chris has been in jail for 20 years. I mean, what could be wrong?

Then it really got good. Judges for Justice headed by a retired Superior Court judge from Washington got involved. Judge Heavey saw the tapes of the 7 polygraphs and was appalled. Polygraphs are supposed to be used to assess the credibility of the witness. That’s when the team got involved. You can read all the reports from the team members here. The one from Steve Moore is 85 pages long.

They also talk about why the judicial system and the police are sometimes hesitant to look at things from a fresh angle in cases where they may have made a mistake. But what could have gone wrong?

I’m guessing it was after 48 Hours got involved along with Judges for Justice that the Prosecuting Attorney’s office decided to offer Chris a deal. Accept the murder charge, we drop the rape charge and you have no probation, and you’re out of jail in a couple hours. Chris had seen so much go wrong, that should never have gone wrong he took the deal. Within 48 hours Carol Dodge, Michael Usry, Dr. Hampikian and others were in the courtroom. The judge in the case had to accept or reject the deal. He asked Chris if he had read every line of the document and he said he had. So how I hear this? Yeah, we sent you to prison for 20 years for a crime you didn’t commit, had nothing to do with, and if we let you out 10 years or more early and don’t put you on probation for crimes you didn’t commit, you say “no harm, no foul” and go your way. Carol Dodge says Chris is another victim of the crime. He is. As is Michael Usry who after court that day was asked by a detective to come with him. They wanted to show him a composite using new DNA technology that can make a facial sketch based on DNA. Michael said he didn’t want to look at first, thinking ‘what if it’s someone I know?” But it wasn’t. It was a face he was unfamiliar with. On July 12th of this year, Michael got a letter with a DNA report that cleared his family with 87.63% certainty that the murderer was not in their family. Wow.

Another interesting person interviewed for the show was Dr. Erin Murphy, A New York University Law professor and author of Inside the Cell: The Dark Side of Forensic DNA. She points out that this familial DNA raises real privacy issues of law enforcement trolling data banks to see if your brother, father are breaking the law. Consider the government’s insatiable appetite for biometric data, REAL ID and that really is a concern. Murphy points out that Usry’s family may have had nothing at all to do with the murder. She maintains that 99% of the people match to one another on a genome, that there could be a match to someone completely unrelated on the other side of the globe. It’s all dependent upon the quality of the match. So what in this case, could have gone wrong?

And actually, that is the answer. When you are dead set on seeing a situation, object or person in a certain way because you have this set of clues, this set of (DNA) data, this set of preconceived notions (it’s a AR-15 that happens to spit shotgun shells) we do ourselves and no one else any favors to insist on not considering any other possibilities.

Yes, as one person posted on my Facebook linked story, you can request that your DNA profile be deleted. I have no idea how long they would take to do that, if they actually do delete it. I suspect it’s a lot more like a NICS check and once they have it, they have it. Would the sell it? Who knows. But who would ask to have their profile deleted in the first place? I mean it’s not like Billy Bankrobber is sending his DNA in to see if he’s really a Viking or Scottish or Kenyan. It’s nice people, who want to know if they should buy lederhosen or a dreidel. They would never think 15 years down the road this is going to get my son in hot water because ___________. I mean it’s not like the government has ever used it’s (IRS) power to go after people (Joe The Plumber) or groups (The Tea Party) it doesn’t like, right? I mean, what could be wrong with that?
