9th Circuit is in a crack this time

Riverside, California Sheriff Stan Sniff Sued for “Discriminatory and Unconstitutional” Handgun Carry Policies in Federal Court
After purchasing a handgun with the intention of eventually lawfully carrying it for self-defense, plaintiff Arie van Nieuwenhuyzen asked the Riverside County Sherriff’s Department how he could apply for a “CCW” license to carry it in public. But the Sheriff’s Department told him that, because he was a legal U.S. resident and not a U.S. citizen, he could not even apply for a license under Sheriff Sniff’s handgun policies and practices. That, the plaintiffs say, is unconstitutional.

Here is the Complaint. Good reading.

As I said, the 9th is in a tough spot of their own making.

Historically, 9th Circuit Courts have done their damnedest to uphold almost every California infringement of Second Amendment rights, going so far as to support a law requiring nonexistent “microstamping”.

On the other hand, a 9th Circuit Appellate panel did recently rule in favor of open carry. And that’s a precedent that may apply here, since California doesn’t allow any unlicensed carry.

What really gets interesting is that van Nieuwenhuyzen is challenging a blanket policy, one which appears to be in violation of California state preemption laws.

Sniff’s department, rather stupidly, did not reject van Nieuwenhuyzen’s application on the usual (and bogus) “good moral character” grounds. They refused his application because he isn’t a citizen. That was a mistake.

While I’m sure most judges in the 9th would like to uphold that policy (and often rule in favor of the state versus any sane reality), Sniff et al screwed up.

To find for the sheriff, the judge would have to find that the policy of a blanket ban on noncitizen legal residents — regardless of “good moral character,” community standing, whatever — is in the interest of “public safety.”

That noncitizen legal residents are an inherent threat to public safety. Simply by existing.

I almost hope the judge (and the 9th Appeals Court) is that stupid. If legal residents are an inherent threat, just imagine what a threat illegal aliens must be.

That would provide a precedent to challenge every “sanctuary” policy for illegal aliens out there. You know, the illegal aliens that Democrats expect to be voting for gun control in the mid-terms.

Or the judge (and Circuit) could opt for sanity, and we still chip a –admittedly small — hole in arbitrary CCW denials.

Hand ‘em out like candy

Is there perhaps a positive change in the wind for beleaguered Israeli citizens? For several months now they have endured rockets being shot at them from the “two state solution” known as Gaza. Gaza was a fairly prosperous area prior to Israel withdrawing from the area and the citizens of Gaza electing hamass. They’ve endure rockets, bombs, firebombs, rocks, snipers, falcons being murdered by having devices attached to them so they could set more of Israel on fire than they could reach with a fire kite. All because they love the land so much they feel compelled to burn it all. There was recently a demonstration in Tel Aviv by the citizens of communities located near Gaza. They feel the government is doing enough/much/anything (circle the correct answer) to protect them.

The protesters shouted “the government must wake up – the south is burning” and “we are not cannon fodder.” They carried signs reading “the south is burning” and “we are tired of burned fields, we are tired of our children crying.”

They have darn good reason to think this way. In Orwellian double speak worthy of Yasser Arafat’s taqiyya of saying he wanted peace then explaining to the ticked off arabs he was just saying that for political reason we have this

After 250 rockets from Gaza hit Israeli locations, one a heavy Grad, Israel’s security cabinet meeting Thursday, Aug. 9, directed the IDF to continue to pursue “powerful action against terrorist forces.” This was tantamount to a decision against a major Israeli military campaign against Hamas at this time, while instead carrying on with tit-for-tat air strikes as before, and leaving the targeted communities to their despair. Some 19 people were injured in the last two days. Hamas is therefore still allowed to call the shots, exactly as it has done in the last four months, while inflicting in Israel diverse brands of terror.

The daily attacks by other arabs continue with stabbings, pro-tip, quit giving the bodies back. They don’t give Israelis back their slain. Arabs hold a big funeral, and a bunch more of them crawl out from under rocks and come into Israel to try to get money and fame by killing Israelis.

Chum Bucket, 31, approached several police officers near the Temple Mount on Friday afternoon. He tried to stab one of them with a knife before being shot dead by the officers who were at the scene.

If he’s going to attack armed police do you think he will hesitate to attack who he thinks is an unarmed vulnerable Israeli?

And he’s not the only one.

Israel Police on Wednesday said that a terror attack in Jerusalem was foiled last week.

In a statement, Israel Police said that officers operating in Jerusalem’s Old CIty noticed a suspicious individual and detained him. Upon searching the suspect, the officers found a knife and tear gas.

The suspect is a 26-year-old Arab resident of Hevron. He was immediately arrested and taken to the police station, where he was interrogated.

The criminals of course are armed, so gun control is working great there.

Police suspect the target of this morning’s shooting at a vehicle in Tel Aviv’s Kikar Hamedina Square was Ben Cohen, a criminal known to police.

Shots were fired from a scooter passing the vehicle where Cohen sat. No one was hurt and massive police forces were called to the scene.

Things are getting so serious the UN, which does not believe in the human right to self-defense, is thinking about getting involved. United Nations: Peacekeeping could protect Gazans from Israel

Are you kidding me?? Forget about Israel and the IDF you ignorant blow-hards. How about doing something about this? NIS 1 million deducted from PA transfers over torture. Need I mention they are torturing their own people. Or this little detail IDF foils Gazan infiltration attempt. Dead Jews do not concern the UN. Remember that, plan accordingly.

So, for the good news.

Well, we don’t have to “what if”. He applied, he was denied and the injustice continues. Apparently a James Comey (Israel version) works in the Police Department. The media knew Elor had been denied before he did. The man applied because his life was in danger, and it was in danger originally because of the liberal left being in full control of the legal process.

Terrorists do not hesitate to attack armed soldiers, police or guards. They most certainly will not hesitate to attack presumably disarmed Israeli citizens.

Palestinian youth on a stabbing rampage murders an Israeli man, injures two

A 17-year old terrorist climbed the security fence into the Adam community north of Jerusalem Thursday night, July 26, and slashed one victim after another.  Yotam Ovadia, an Israeli man of 31, whom he repeatedly stabbed, died soon after from multiple wounds, a second man, aged 58, was badly hurt and a third though injured managed to pull his gun and shoot the killer dead. The terrorist came from the nearby Palestinian village of Kobar. He must have studied the electronic fence in advance, because he was able to climb over without triggering the sensors for an alarm.

And in the end, it was a good guy with a gun that stopped the carnage. The security fence didn’t stop them, guards didn’t stop them, patrols didn’t stop them. A good guy with a gun stopped him.

Don’t be stingy Erdan, hand those gun permits out like candy.

Poll: Carry in California

The Mercury News & East Bay Times Editorial Boards are afraid “that people who can legally carry concealed guns in their home states could do the same” in California if Congress passes reciprocal carry legislation. The thought of hordes of law-abiding people swarming the state apparently terrifies them. But that presupposes that law-abiding people who want to routinely carry concealed want to go to California, which I can personally attest isn’t necessarily the case.

If you are a non-Californian with a CCW license do you have any interest in traveling to California with your sidearm?

Hate In America

I watched part of a TV show last night, reminding me why I seldom watch TV, that and lack of time.

The show was on Investigation Discovery, and out of the two stories covered, one of them was the shooting at the Jewish Community Center in Overland Park. The criminal was an American Nazi. There was a video clip in the show of him sitting in the back of a police car yelling “heil hootler”! Yeah, actually I did mean to misspell it. Petty, I know. Pictures of him doing the hootler salute, the nazi flag, clips of his speeches and the whole 9 yards. Did he hate Jews? Oh yeah. He was asked if he was sad none of the victims he shot were Jewish. No, he considered those he shot Jewish collaborators. Was he an insane madman? Darn skippy.

All sounds like a well covered show, right? You would be wrong.

The show was about lionizing something called the Southern Poverty Law Center, an evil institution run by your typical flaming liberal Morris Dees.

Let me tell you a little bit about the SPLC from something that was on the national radar a few years ago in 2009. It happened in the state of Missouri, but it made waves across the nation when people found out.

The Missouri Highway Patrol issued a report to their troopers called the MIAC report. It was issued by the Missouri Information and Analysis Center (MIAC), a branch of the state’s Highway Patrol. This scholarly paper warned their officers to be wary of the following people that represented a danger to the officers and the public in general.

Christians, political conservatives, patriots, pro-lifers, libertarians, gun owners, and constitutionalists and militia members. Those that display Constitutional Party, Campaign for Liberty, or Libertarian material, such as bumper stickers. These members were usually supporters of former Presidential Candidates Ron Paul, Chuck Baldwin, and Bob Barr.

Any car sporting a pro-life, pro-free speech, pro-Second Amendment bumper sticker was to be viewed with extreme caution.

And where would the Missouri Highway Patrol get such a insane memorandum? Why, from the SPLC. Who never met a group of conservatives or conservative candidate they didn’t label as a threat or a hate group.

After a huge outcry from enraged conservatives and conservative lawmakers the MO HP retracted their report and the blame flinging session began.

Other states had reason to be concerned. The MO HP is part of a “fusion center”. They assimilate and disseminate information to state and local agencies. At the time, the federal Department of Homeland Security’s Web page entitled “State and Local Fusion Centers” said

Many states and larger cities have created state and local fusion centers to share information and intelligence within their jurisdictions as well as with the federal government….

In 2009 DHS “had deployed intelligence officers to state fusion centers in: Arizona, California, Colorado, Connecticut, District of Columbia, Georgia, Florida, Illinois, Indiana, Louisiana, Maryland, Massachusetts, Michigan, Minnesota, Missouri, New Jersey, New York, North Carolina, Ohio, Oregon, South Carolina, Texas, Virginia, Washington, Wisconsin.

I’m sure there are more now.

It was the prelude to what happened a couple years later.

It started with a request from the Social Security Administration jointly with the ATF, for the entire list of Missouri Concealed Carry permit holders as part of an investigation. An investigation which was dropped the minute the ATF received the list of all Missouri CCW holders. The request was made of the Missouri Department of Revenue. The Mo Department of Revenue, which illegally as in against Missouri Law, but at the direction of Gov. Jay Nixon had begun implementing REAL ID. The Mo DOR attempted to mislead the legislature by not telling them the ATF had been part of the requesting agencies. It is against the law to supply a list of gun owners to the Federal Government.

So who would break the law like that? The Missouri Highway Patrol.

Testifying before a Senate committee, Highway Patrol Col. Ron Replogle said the concealed guns list was given to an investigator looking into potential fraud involving Social Security benefits for the disabled. But he said the investigator never was able to read the encrypted information and ultimately destroyed the computer discs.

Republicans expressed concern that the privacy rights of Missouri residents are being infringed, but members of Democratic Gov. Jay Nixon’s administration insisted there was nothing wrong with the information sharing.

Now just a word about that encrypted disc that Replogle said they sent. It was NOT encrypted, it was in a password protected excel file. The password was included in the cover letter. The cover letter that was sent WITH the discs. The cover letter that was sent with the discs via REGULAR mail.

Why would the Mo Highway Patrol do such a thing? Well, obama syncophant jay nixon directed them to, and after all, gun owners are the enemy, right?

So back to the TV show. The “courageous” Morris Dees who has armed security people at his home recounted an incident where intruders gained access to his grounds. He related the story of getting his guns, and his daughter had a .22 she was a good shot with, and they huddled together with their guns in their safe room till the danger had been resolved.

I kid you not.

I can’t make this stuff up. And now the SPLC is probably going to have this dam darn TV show telling uninformed people that this is a great group. Peachy, just swell.
